FACTS OF THE CASE
a. Course Enrollment: The Complainant enrolled for a course with PlanetSpark on April **, ****, and made a total payment of INR **,*** through Razorpay, with transaction ID: pay_QPKnCc*Wr*IKt*.
b. False Commitments: The enrollment was made based on specific representations and false commitments by PlanetSpark's sales executives. The Complainant was assured that the course would focus on grammar improvement for her child.
c. Discovery of Deficiency: The first and only class was attended on May **, ****. Immediately after this single class, the Complainant realized that the course content and teaching methodology did not align with the commitments made by the sales executive and was not suitable for her child's needs, which was to improve grammar.
d. Request for Cancellation: As advised by the sales executive, the Complainant immediately raised a request to discontinue the course on the very next day. The request was clear and concise: "This is to inform that we are not continuing with subscribed course and requesting for the fee refund amounting to Rs. *****.**, as by attending the first class itself we realised that this course will not help my kid. We are looking for a Grammer improvement class and this is something else."
e. Unfair and Undisclosed Policies: In response to the cancellation request, the Opposite Party began a series of attempts to retain the Complainant. When these failed, they introduced previously undeclared and unfair rules, which were never disclosed at the time of enrollment. They claimed that as per their "terms," the refund would be subject to significant deductions, including a **% processing fee, and that the refund would only be initiated after a minimum of ** classes were completed. This was a clear act of misrepresentation and an unfair trade practice, as these terms were not mentioned before or during the enrollment process.
f. Unjustified Deductions and Delayed Refund: After months of follow-ups and no proper response, PlanetSpark finally provided a breakdown of the refund, showing unjust and arbitrary deductions:

g. Continued Delay and Harassment: Despite promising a refund of INR **,***, the Opposite Party has still not processed it as of September *, ****. Their representative, Karan Gupta, has repeatedly provided vague responses, stating, "You can expect the *rs razoray x link within this week," with no resolution. This ongoing delay and lack of a proper refund constitute a continued deficiency in service and harassment.
