This complaint addresses the fraudulent practices and deficiency in service experienced during a transaction with Cashify concerning the sale of my iPhone **. The company initially provided a higher quote but later reduced the offer after falsely alleging that the iPhone had a “duplicate screen.” Despite my clear assertion that the device was never repaired or serviced by any third party, the company's representative insisted on taking possession of the phone for further inspection without the necessary equipment to verify his claims.
This constitutes a clear case of misrepresentation under Section ** of the Indian Contract Act, ****, as well as deceptive trade practices under Section *(**) of the Consumer Protection Act, ****.
The complaint demands either a full refund based on the original quote or the immediate return of the iPhone in its original condition, along with compensation for the undue stress and inconvenience caused. If these demands are not met within * days, legal action will be initiated under Section *** of the Indian Penal Code, Section ** of the Consumer Protection Act, ****, and Section ** of the Indian Contract Act, **** for cheating, deficiency in service, and breach of contract.
