Subject:- Fraud by Amazon India and Amazon Delivery Associate in Order No. #***-*******-*******
Dear Sir,
*. I have purchased a Samsung Galaxy Watch Active * (Bluetooth, **mm)- Silver, aluminium Dial, Silicon Straps for Rs. **,***/- (Rupees Sixteen Thousand Five Hundred Ninety only) bearing Order No. #***-*******-******* on **th September **** from Amazon India Website (‘Order’). I had made payment of the aforesaid Order with my Debit Card on Amazon India Website.
*. The aforesaid order was delivered by Amazon delivery agent at my home address i.e. Bunglow No. ***, Umaid Heritage Colony, Ratanada, Jodhpur- ****** and the same was collected by my mother and her name is Mrs. Manju Mehta.
*. However, when the aforesaid order was delivered, I was shocked that the package didn’t contain the charger of the watch. At the same time, I contacted the Amazon India Customer Service and immediately requested to return the aforesaid Samsung Watch. But, the Amazon India Customer Service refused that I can’t return the Order but can place replacement of the same due to some Amazon policies.
*. I had no choice but had to agree with such one-sided Amazon India policy and accepted the replacement of the Order.
*. Thereafter, the delivery boy of Amazon India came to my house to deliver the replacement of the Order on **th October **** and however, the box of the replacement Order was not sealed pack and my mother refused to accept the said box and I immediately contacted the Amazon India Customer Service and they informed me that to not accept the replacement package as the same was not sealed pack and informed me to return the original watch came with the Order back to the Amazon delivery boy.
*. Thereupon, I informed my mother and she handed over the watch which came with original Order to Amazon delivery boy.
*. After that I immediately followed up with Amazon Customer Care service about the refund of money and they informed me that once they received the original watch at the fulfilment centre and within ** hours, they will refund my money to the original payment method.
*. Even after the passing of ** hours, Amazon India didn’t facilitate the refund of money towards the return of Order, thereupon again I contacted the Amazon India Customer Service and they informed me that wait for some days and refund will be processed automatically.
*. However, even after passing of more than ** days, there was no sign of refund of my money in regard to return of my Order and again I contacted the Amazon Customer Care service and thereupon they informed me that they can’t process the refund of money because they didn’t received the original Order back at their fulfilment centre despite my mother handing over the original Order on **th October **** to Amazon delivery person.
**. Also, I have the CCTV footage of my mother handing over the Original Order to the Amazon delivery boy and not accepting the replacement order which was not sealed pack. For your investigation purposes, please find enclosed the CCTV footage.
**. It is very clear from the CCTV footage that the Amazon Delivery boy and Amazon India have done the fraud on me by not refunding my money despite me returning their original Order back to them.
**. Request you to file First Information Report on the basis of my aforesaid complaint as Amazon India is not cooperating with me and not refunding my money and also they are not disclosing the name of delivery person who had come on **th October **** to deliver the replacement watch and also they are not disclosing the local address of Amazon India in Jodhpur.
**. It is very clear that Amazon India is in hands in glove with the Amazon delivery person as they both have done the fraud on me and Amazon India is not investigating at all despite me providing crucial CCTV footage long back to their Amazon Customer service team.
**. Please take immediate action against the Amazon delivery person and Amazon India and instruct them to process my refund of Order asap otherwise I will have no options but to approach Consumer Court and take the help of local Police in launching FIR against Amazon India and Amazon delivery boy.
