Defective Goods Shipped Open

Complaint filed against: Galaxy Pencils Mfg. Co.
We have placed an order for 640 Cartons / 153600 Boxes of Kkleeo No. 2 pencils from M/s. Galaxy Pencils Mfg. Co. vide proforma invoice no. P 1516-144 for an amount of Usd 43,008. The samples were reviewed accordingly for the items stated in the Proforma Invoice.
Accordingly, an amount of Usd 18,278.40 was paid as advance towards the shipment as per the agreed terms and conditions vide TT ref. AC 50623H000635 dated 25 June 2015. The balance amount was paid at the time of shipment and the shipment was dispatched on 29 July 2015 vide invoice no. 1516-149 vide B/L No. Maxnsa13771516 in Container No. Mxcu0030208 from JNPT to Jebel Ali port. The shipment was well received at our warehouse on 17 Aug 2015.
After inspection of the goods we had noticed the deficiency in quality of the shipped products comparing to the samples. The same was intimated immediately to the Mr. Aditya R. Dhoka, Director of M/s. Galaxy Pencils Mfg. Co.
After negotiations Mr. Aditya R. Dhoka agreed to compensate towards the deficiency in quality of goods supplied (Copies of Emails attached) either by selling the products to other countries or offering the same to other distributors in UAE and refunding our amounts. Furthermore, we had been following up with them regularly on this issue.
During our visit to the office of M/s. Galaxy Pencils Mfg. Co. in January 2018, M/s. Galaxy Pencils Mfg. Co. have denied their assurance as confirmed initially and agreed to compensate Usd 9,000 by the way of discount in our next order.
Whereas the complete quantity of goods valued usd 43,008 is lying in our warehouse as we are unable to sell any quantities due to the deficiency in quality. The defective goods are also occupying warehouse space and further amounts need to be spent to scrap the goods.
We request you to intervene in this matter and arrange for compensation and we shall bear the cost to scrap the material in UAE.
