Modern Habitat Pune - Not getting complete refund from Modern habitat

Respected Sir/Madam,

I, Subedar Singh Dhakad, hereby submit this complaint against Modern Habitat, Pune for deficiency in service and unfair trade practice, as detailed below:

*. Facts of the Case

That on *th January ****, I paid a token amount of ₹**,*** to Modern Habitat, Pune for initiating interior work at my premises.

Due to unavoidable circumstances, I decided to cancel the interior work. Accordingly, on **th January ****, I informed Mr. Dhruvin (representative of Modern Habitat) via phone call to not initiate any work and requested a full refund of the token amount.

On **th January ****, I formally communicated via email to Modern Habitat informing them about cancellation of the project and requesting a complete refund, as no work had been started and no expenses were incurred by them.

After several follow-ups through calls and emails, Mr. Sanket from Modern Habitat confirmed via email dated **th January **** that I would receive the refund.

However, on *rd February ****, I received only ₹**,*** in cash from Mr. Dhruvin. The company refused to refund the remaining ₹**,***, stating that they have a “zero refund policy” for token amounts.

At the time of payment on *th January ****, I was never informed verbally or in writing about any such “zero refund policy.” No such condition was explained to me before accepting the token amount.

Furthermore, after initially confirming via email on **th January **** that the refund would be processed, the Opposite Party later denied refunding the remaining amount, which clearly amounts to deficiency in service and unfair trade practice.

Copies of all email communications are attached as evidence.

*. Grounds for Complaint

The Opposite Party failed to disclose their alleged “zero refund policy” at the time of payment.

No work had commenced and no expenses were incurred by them.

Written confirmation of refund was provided on **th January ****.

Refusal to refund the remaining ₹**,*** despite confirmation amounts to:

Deficiency in service

Unfair trade practice

Misrepresentation

*. Relief Sought

In view of the above facts, I respectfully pray that this Hon’ble Commission may kindly:

Direct the Opposite Party to refund the remaining amount of ₹**,***.

Award compensation for mental harassment and inconvenience.

Award litigation costs.

Pass any other order deemed fit in the interest of justice.
