On **/**/**** I collected an offer coupon from Amazon that promised cashback of up to Rs. **** on making a third party (Coolwinks) purchase of Rs. **** or more. The offer was valid from **/**/**** to **/**/****. One day later on **/**/****, after reading all the offer T&Cs, I made the purchase of Rs. ****. The offer had two parts- an amazon shopping coupon worth up to Rs. *** and flat Rs. **** cashback in the form of Amazon Pay balance.
After placing the order, I received the shopping coupon worth Rs. *** but did not receive the Rs. **** cashback in my amazon pay wallet. Since it was instant cashback offer when contacted I got the following series of response from Coolwinks and Amazon in the chronological order:
*. On **/**/**** telephonic conversation, Coolwinks said it will take up to ** hrs to credit the cashback.
*. On **/**/****, telephone as well as through email Amazon said the matter has been escalated to back end team and will be resolved within maximum *-* days.
*. On **/**/****, telephonic conversation Amazon said the team did not provide any update on the issue.
*. On **/**/****, through email Amazon acknowledges a system error and assures of manual credit of cashback within * days.
*. On **/**/****, through email Amazon confirms it is an issue with many customers and a team is working with Coolwinks to sort it out. I was asked to wait till **/**/****.
*. On **/**/****, Amazon gave the update that Coolwinks confirmed an error on their part because of which the promotion did not work. Amazon asked me to contact Coolwinks and they will credit the cashback. I did not contact Coolwinks because when I had in the past I was told the cashback is being provided by Amazon and I should be contacting them.
*. On **/**/****, I called Amazon and got the following update through email- "Coolwinks says the customer applied instant discount code/promo code/instant discount offer/cool cash rendering me ineligible for cashback".
*. Since I had not applied any promo code/cool cash I contacted Coolwinks to clarify on this. Coolwinks gave me a different reason than what Amazon had me believing. It said, "The offer was not valid on Coolwinks app and since I had used the app for making the purchase, I am ineligible for cashback." This term was not mentioned in offer T&Cs of Amazon, rather it was made clear that the offer is valid on Coolwinks app as well.
*. On **/**/****, when I confronted Amazon again for giving false information this time amazon tried to isolate itself by saying that flat Rs. **** was advertised only on Coolwinks and not on amazon a completely absurd reason. Amazon asked me to get it resolved by Coolwinks.
If they are referring to the same offer there are major differences between the T&Cs of Coolwinks and Amazon.
Amazon has a different definition of "Qualifying transaction" than Coolwinks. The app is a qualified mode of purchase in Amazon T&Cs but not in Coolwinks T&Cs.
Because of this, Amazon is giving other lame excuses like I have applied promo code that amazon did not mention about that part of the offer on Amazon app it was only on Coolwinks etc. On the other hand, Coolwinks is arguing and rightly so that I have placed the order on Coolwinks app which is not a qualified mode of purchase as per their T&Cs. The thing is, I read both the terms and conditions before placing the order. I saw the differences as well. I even contacted Coolwinks and Amazon regarding these errors. I was told my point has been noted. In the end, I concluded these two offers have to be different because their T&Cs are different. Moreover, since I got the offer from Amazon I am bound to comply with all of their T&Cs which I did.
My argument is if amazon says the cashback was to be approved by Coolwinks it must have complied with Coolwinks T&Cs by including them in its own T&Cs or at least referring the customer to read Coolwinks T&Cs which it did not. For a customer like me, I got the offer from amazon satisfied all its T&Cs and should get the offer benefits. If it is an error on Coolwinks part it is not a concern for me but for amazon. Why shall the consumer bear the burden of a mistake made by these companies?
This scam is going on on paytm and phonepe as well and many users on Twitter have voiced the same complaint.
