- Got defective phone, no resolution(neither refund/replacement) provided by eBay nor acknowledged by Open
I ordered a mobile named "Lenovo K6 Power Gold 32GB 3GB- 4G -Certified Refurbished -Excellent Condition" and i received it on 28th April. It was written for that product that the handset is in excellent condition and is fully functional with minor dents and scratches, but when received that mobile, I was not able to communicate with anyone with that phone because the voice i am transferring through my side wasn’t reachable to the other side and hence even after ordering mobile for 5999 rs, it wasn’t of any use to me, because major primary usage of any phone is calling and when that too not properly satisfied then how can you say that the phone has been 100% quality tested and is fully functional. Not only regarding calling, but issue becomes messy when i found that without any heavy usage just opening the phone for 5 to 10 minutes makes the phone gets so much heated up, and as the battery is non removable this issue becomes more serious as I haven’t installed any extra apps in that, as when the mobile can get heated up with prebuilt apps then what will happen when i will start putting apps and data in it.
I filed an eBay guarantee claim regarding the same on 29th of April and the eBay guarantee claim has been raised on my issue. I not only messaged my problem I was facing literally to the eBay but also to the seller "F1 Info services" with seller id "health_happinesspvtltd". And in return the message I got from the seller was to contact a not working number 1800 102 7212 which always remains busy. So I wasn’t able to contact that number too. And after the deadline got over which eBay gave me to wait for 4 days ie from 29th to 3rd April, I contacted them on the 4th day but they just told me that wait for 24 hrs. a call will be made within 24 hrs. So as we have waited for 4 days we decide to wait for another day. Literally we were completely frustrated and exhausted by calling and contacting eBay and the seller. It seems we have to solve their problem not they as they were literally taking no pain to help us and provide possible solution. I was having my end semesters examination on 4th may and the mental problem and the cost of my energy and time I have invested in this issue to get phone for my father replaced was irreparable. I can’t get that precious time and valuable energy I have invested out of my busy schedule for preparing for my end semester exams. I came into unmanageable stress anxiety and depression. There was pressure from my parent’s side that you have ordered the phone and you made our money lose and you are responsible for that. But nor eBay nor the seller understand what type of situation I am going through. It hugely affected my mental health.
Finally, we got a call next day from eBay. And I was speechless when it said me instead of helping me get my issued resolved that your product comes under 3rd party warranty and product is not under eBay guarantee. So we are just closing your claim and you only have to contact seller regarding this. And not only this the seller didn’t provide me proper accessories as there was no charger when I uncovered the box. And eBay just said that we will just provide the compensation of 500rs as eBay coupon to get your charger and cables. Rest for the mobile you have to contact to the seller itself and seller was not contactable, so I just called their customer care and the answer I got from their side was horrible. They said that if any problem, you have to come to our service center only which is 100 kms far away from my town in Jaipur or if you can’t come you have to make courier from your side at your expenses. I even argued that my time and energy already wasted so much in this issue still you want me to mess up with it more. I asked them as the defective and faulty product was given from your side so you are responsible for shipment charges and you should arrange pick and drop agent from your side who will come to my delivery address and pick the phone and get it either replaced or repaired. But they just refused me that sorry we can’t make it available, the agent can’t come to your house, so from your side you only have to make the courier or shipment. After a heated discussion they just gave me another deadline which they never really followed on that wait for 24 hours to 48 hours we will see what to do with your issue. I just asked them that to confirm whether you will arrange pickup or not requires 48 hrs? And in return they replied that its seller’s policies.
So finally after waiting for 6 days, getting completely exhausted and frustrated I have no other option other than to file a complaint against both eBay and the seller.
So please help me getting a sum of Rs. 4,000/- towards the physical strain and mental agony I have suffered and financial business problems my father had to suffer without proper phone as he had to arrange different mobile to communicate plus he was expecting the mobile to use by end of April but wasn’t able to due to the defective piece sent, including the issue of my phone get resolved either by complete refund(in my account of 5999 rupees) or replacement or repair.
