Dear Sir,
With this complaint I would like to bring to your notice of a very faulty and unsatisfactory service rendered by Mr. Shyam from Smart IT Solutions and Tech based out of A.S. Rao Nagar in Secunderabad, Telangana.
I would like to recount that initially Mr. Shyam has falsely promised that he would give good working condition laptop computers for INR **** per month and upon visiting his location, he immediately changed his stance that the computers that he can give for rent for INR **** is very low quality and would not function satisfactory. This is a false marketing trick and a cheating malpractice and a fraudulant practice engaged by him to lure towards his services and later on lock the clients into it.
We clearly specified and informed Mr. Shyam that we need a decent working laptop for my daughter who is studying high school for her regular school homework and other research activities and including conducting of online exams.
Upon listening to our requirements, Mr. Shyam recommended that we go with INR **** per month HP brand laptop with such look and quality for school usage. We agreed to it and taken delivery of the same by paying the amount of INR ****. The first delivery of this laptop product was taken by us in the month of late July month of ****.
Upon using this laptop for only ** days, and having continued to make payments towards his rental services, my daughter faced an issue with the laptop in the school where all of a sudden while she was writing an exam (important board level exam), the motherboard of the laptop failed with fumes coming out of the laptop and the laptop completely was shut down without any operational life in it. This was the first major setback we received from the laptop service provided by Smart IT solutions.
When we complained about the same issue with Mr. Shyam and handed over the failed laptop, he looked into the matter and informed that he would try and fix the issue and get back to us within ** days. After ** days, he has informed that the laptop that was failed is no more repairable and has a motherboard failure. For these ** days my daughter was suffering at the school tremendously without any laptop and she was finding it difficult to cope up with her school work and research projects as the school has made brining laptop to the school mandatory for all school work as it is a International School with computer oriented curriculum.
After ** days of suffering, Mr. Shyam agreed to give another replacement laptop of HP brand which is far inferior quality product as my daughter while using it in the school has faced issues from their IT department, that this laptop cannot handle software installation and upgrade that is required for her studies in the school. We have informed about our plight with Mr. Shyam several times over Whatsapp and several calls.
But instead of resolving our main issues, he has always been pushing for payments for laptops which are not even meeting our basic need for school purpose and he kept claiming that by just keeping a hardware piece with us we are liable to pay. We would like to bring to your notice, that we have agreed to pay for a properly operational laptop along with courteous and sound technical support from Mr. Shyam of Smart IT Solutions. We would like to bring to your notice and complain that we did not receive both of those services from Mr. Shyam and compelling us to make payments equals to extortion of money in this scenario.
Upon that his interactions with me being a woman and a mother, he has been extremely unprofessional, very rude and intimidating behaviour towards me all along not taking into account my daughter's need for a proper working laptop and instead he kept on messaging me and literally forcing me to make payments towards a service that is completely not satisfactory and extremely faulty and has caused severe liability towards my child's school education as she has reschedule several exams due to a faulty computer and had to spend a lot of time and energy and face setbacks in the school due to such bad services rendered by Smart IT solutions.
Not only that, the replacement laptop that he had given, it had failed with a loud shock and fire in the charged while my younder daughter was in the vicinity of this laptop and she literally felt the shock as she was leaning closer to the charger and fell back into the Sofa with a severe traumatic feeling that lasted several days for her.
We have reported this incident also wit Mr. Shyam and he is very much aware of it. In reply he suggested that he shall give good charging cable this time. So our question is why give spurious products which are so dangerous and life threatening in the first place? Is this not a fraudulent practice?
All in all Mr. Shyam kept on with his rude behaviour and kep haggling only for money and completely ignored that it was his product and service that we are interested in receiving and would only pay towards a satisfactory service and product which once again were completely missing the point.
Finally we agreed to go to his office in the month of October **** and settle the matter once for all but his bad manners and misbehavior continued and he kept talking to me and my husband in a threatening and intimidating way. And was not allowing to settle the matter amicably.
Having said that, we request the consumer court to take strict action agains Smart IT Solutions in A.S Rao Nagar and make Mr. Shyam apologize towards all his bad services and bad behavior. We would also like to reiterate that we are not liable to pay any amount owing to the extremely poor and non-existent service rendered by him. We would like to reiterate that inspite of all these ordeals, we had already paid Mr. Shyam an amount of around INR **** inspite of such bad experiences.
If possible, we would like to recover that amount from him for the distress, loss and dangerous accidents caused by his very poor and badly maintained faulty products that he passed on to us.
