Myself and my wife booked a holiday trip with make my trip on booking ID: NL*********XXXX from Jan *nd to Jan *th ****. This trip was inclusive of private car transport and accommodation managed by MMT.
Total Trip amount: Rs ***** *N Shimla,*N Manali & *N Chandigarh (Pick up and drop from Delhi)
On *nd Jan we boarded Air India flight from Hyderabad and landed in Delhi at *AM, and eventually started our journey to our first destination Shimla in the car arranged by MMT.
We reached Shimla and checked into hotel (Hotel Woodrina) at approximately * PM. The next day *rd Jan ****, as per the itinerary we were taken to Kufri and Shimla mall road.
Approximately by *:** AM on *th Jan **** we checked out from Hotel Woodrina in Shimla and were enroute Manali, our next destination as per the itinerary.
At around **:** AM near CH Markand, we met with an accident with another incoming car.
Myself and my wife were sitting behind trying to rest ahead of the tedious trip. In a sudden jerk, I hit my face to the driver’s seat, which in turn caused laceration on my upper lip and injuring my upper front teeth. My wife hit her head to the side of the car at the same moment.
After we stepped out of the car in a shock, I was constantly bleeding from my mouth and unaware of what had happened to us in that moment. My wife was also in pain and crying inconsolably.
We were soon rushed to the Primary Health Centre in CH Markand to emergency room for initial treatment.
As per the Doctor diagnosis, I had to be treated with two stiches on my upper lips and was advised to rush to Bilaspur (HP) Regional hospital for further consultation.
At Bilaspur Regional Hospital, I consulted the dentist and he did the minimal examination and advised antibiotics for pain and suggested me to rest and avoid solid intake.
As this was a clear accident case, the other party filed a case on our MMT driver Amit and we were interrogated and our witness statements were recorded by the Namhal Police officials in the hospital.
Since there were few more remaining formalities from police personals, we were advised to stay overnight in Bilaspur.
We checked into Sagar View Hotel in Bilaspur as suggested by the Police on Jan *th evening. We beared all the hotel expenses.
After the accident, Amit was taken into custody by the police and interrogated further.
As this was a major accident for us and I was in uncontrollable pain and was unable to have any solid food, so had to be only on liquid diet. My wife also was undergoing severe body pains. Because of our physical injuries and mental trauma, could not proceed further with the itinerary and wanted to return to Hyderabad for further treatment.
On *th Jan morning, post completing the further formalities with Namhal police, we retuned back to Chandigarh via car arranged by Make my trip.

Since MMT official did not help us in booking a return flight to Hyderabad, we had booked an emergency flight from Chandigarh to Hyderabad for *th Jan (*:** AM) and cancelled our Air India flight to Hyderabad scheduled for *th Jan (with zero refund).
We stayed overnight in Hotel Hamilton at Chandigarh with our expenses.

We reached Hyderabad safely at *AM on *th Jan.
On *th Night we mailed our MMT travel manager and MMT service (servicesupport@makemytrip.com) with the complete details of the incident with bills attached and demanded for a refund.
However, to our surprise, none from the MMT team called us to discuss on the refund and the incident, even on repeated mails and messages and calls. Not even our MMT travel manager responded to our concerns.
We were shocked to receive a mail from one of the MMT representatives stating that only our Manali hotel accommodation will be refunded.
We did not accept the illogical refund and again urged some representative to call us and discuss.
However, our efforts went in vain and they credited Rs **** without our acceptance towards the refund of incomplete trip due to the accident of MMT vehicle in which we were travelling.
We felt there was no logic or justification in refunding Rs ****, which is in no comparison for the amount paid to the total tour and the consequences we had to bear post-accident.
After this also, we patiently mailed them that we our still open for discussion. Since we did not hear back from them and were not satisfied with the illogical refund, we decided to proceed legally.
Besides the injuries and pain we had to undergo, we also had to see the irresponsible and careless behaviour of MMT officials towards our health and hard earned money we spent.
We demand compensation for the below points
*. Since the complete tour was disturbed with added injuries, we demand complete compensation of the package. Total: Rs **, ***.
*. Medicine Bill at Bilaspur Regional Hospital. Total: Rs ***.
*. Demand complete flight fare for Air India (Hyderabad to Delhi and Delhi to Hyderabad)

*. Complete refund of Sagar view Hotel (Bilaspur HP). Total: Rs ****.
*. Complete refund of Hotel Hamilton (Chandigargh). Total: Rs ****.
*. Complete refund of Chandigarh to Hyderabad Indigo flight fare. Rs. **, ***.
*. Driver Amit owes us Rs **** for himachal road transport tax for our trip, which he borrowed from us since he had no cash.
*. Food bill from Sagar View (Rs ****) and Hotel Hamilton (Rs ***). Total: Rs ****.
*. Chandigarh Airport drop at *AM charges (Arranged by Hotel Hamilton). Total: Rs ***.
**. Ongoing treatment for Dental injury, estimated cost Rs ****.
**. Our Mental agony cannot be tagged with any amount, as we and our families only know the pain we underwent because of this incident. Having said that we are demanding a minimal amount of Rs **,*** for our agony.
**. Added to these, we are asked to appear for court hearing at Bilaspur HP for this case in near future, as myself and my wife are the key witnesses as per the police. Let us know, who will compensate for our travel to Bilaspur.
