Hp Laptop - service denied for hp laptop under protection plan

iI purchased an hp laptop pav x*** (priced at Rs. **,***/-) on **th july **** from an hp dealer in bangalore. as a training professional, I need to travel frequently and need to carry a laptop therefore i made this expensive investment to travel lighter. this is to state that i purchased this laptop mainly for my training programs and not for day to day working.
at the time of purchase i was advised by the sales team to take up an additional warranty which was in running at the time that would provide additional * year warranty, * year of accidental damage protection, * year of burglary & theft insurance for notebook, * year of macfee Internet security and uninstal * in * software; at an additional cost of rs ***/- within hp's back to campus offer. i was pushed to take this additional warranty with assurance that any damage or breakage that may occur to the laptop through fall or accident would be covered by hp.
on **nd of January ****, while securing the laptop into a leaf case, it accidentally slipped from my hand and fell on the ground on its base side. immediately on checking i observed that both the left and right side panels where the charging and usb ports are located have a dent. I turned the laptop on to check if any internal damage has occurred but thankfully it came on and the functioning was fine.
i called the hp customer care helpline at *********** on the **rd of january **** and registered a complain of damage that had occurred to the laptop. i also informed the customer representative that not only was the laptop within the warranty period, I also had additional coverage of accidental damage protection. i was promised immediate assignment of a engineer to visit my residence to provide a quick resolution. In fact the representative made a follow up call to me within two hours of registering my complaint stating that he checked my product details and that i didn't have to worry about making any payments as indeed my laptop was covered under accidental damage.
however, i did not receive any service or call till the evening of **th of january **** where an engineer from a local service company called capricot called asking to visit. as i was at work and had not received any prior intimidation of a visit, i requested him to come the next day. however no one turned up the next by noon and i was forced to make an inquiry call as i had taken a day off from work to deal with the laptop issue. at my calling the engineer informed me that he was in mysore and that his office will assign another engineer. after multiple escalation calls made by me that day to both hp and capricot, another engineer visited my place late evening by * pm. he opened the back panel of the laptop and reviewed the internal boards to note the required serial number. He also verified the warranty documents and on a call to his manager, mentioned that the product was under accidental damage. he promised that he would place a request for the damaged parts the next day and as I was engaged in work commitments and doctor's follow up travel, he would visit the following week to fix the panel. i informed him that my training materials were in the damaged laptop and due to the already unacceptable delay in attending to my case, it would impact my work commitments. after reassembling the laptop when he attempted to turn it on, the laptop did not turn on. i informed him that the laptop was turning on before he opened the back panel and he said when he fixes the new panel and check the functioning as well and hand it in good condition. trusting his words and hoping for an immediate solution, i didn't argue.
on the *th of february ****, i received an email from a call coordinator from capricot (responsible for placing parts requests) stating that "regarding the above case id, lcd back cover panel is rejected under adp case as it is cosmetic damage (customer induce damage)". I immediately called the engineer who was assigned to my case about the email and he was surprised as well and offered to call me back after speaking to the lady who had emailed me. the response later that I received was hp's accidental damage team had rejected my case saying it's cosmetic damage and was asked to follow up with HP.
i called hp customer care multiple times ever since and escalated the issue with supervisors who empathized and apologized but provided no solutions. i never received any calls or emails (even responses to my emails) from hp i had to keep calling them during business hours to try and sort this issue. every time the hp representatives feed me with different stories telling me that the accidental damage team has rejected my case, stating their helplessness, promising escalation, asking me to visit customer care center etc.
i have lost * client programs as my material is in the damaged laptop that has cost me a business of rs. **,***/-
i finally made a last call yesterday **th of february **** and when i stated that approaching the legal system was my only way, i was assigned a case manager who emailed and spoke over a call stating he will get a solution at the earliest. It has been ** days today since I filed my complaint on **rd of january ****.
the ordeal has been stressful, emotional, frustrating and has not only costed me mental but professional losses as well.
i was promised accidental damage coverage, **x* customer support, immediate assistance but none of the promises were kept. every call with HP representative in the last ** days have provided me with no help, different information and false promises and the recordings of the calls will prove that.
i am hoping my rights as a consumer will be protected by the consumer forum/ court and no other customer of such an established brand has to experience the ordeal I have had to.
