Dear Sir,
I had booked three seats under "Platinum Seating" category for a show in Kolkata "Bryan Adams - So happy it hurts" on *th August, **** for the date *th December, **** and paid Rs. ***** via my credit card. I took a screenshot of the mobile screen when the tickets were booked. It clearly shows that I had booked "SEATING " tickets and have paid accordingly.
However, when I am now checking in the ZOMATO app, it is showing as "PLATINUM STANDING PHASE *" tickets. Please refer to the attached files where the fraud is more specifically highlighted by red circle. This was explained numerous times via email to ZOMATO representative and over a phone call. I had also given them the option to correct their mistake and change the tickets to "SEATING" category or refund my full money paid immediately to which ZOMATO has expressed their "apologies for my inconvenience "and denied refund.
Then I sent a legal notice to Zomato with a claim for damages of Rs. *.* lacs, post which they called me and offered to refund the amount paid for the ticket. However, I denied the refund and insisted for the damages claim to which they did not respond. However, a week prior to the show my wife sustained an injury and was not in s state to attend the show standing for * hours. This may be noted that had the tickets been of “seating” category, as paid for, she would have been able to attend the show.
Thus, I wrote an email to Zomato that due to medical reasons we will not be able to attend the show and hence the money may be refunded. They refunded the amount to the original mode of payment.
However, I would like to file a case in consumer forum for making false promises by Zomato and also would like to claim damages of atleast * Lacs plus legal charges, against Zomato.
Please le me know the fees for filling the case in Kolkata Consumer Forum court, filing the case and then fighting the case, all inclusive.
