The complainant-Sukhwinder Singh as a gift for his friend Harinder Pal Singh has booked online order with the opposite party for the purchase of Neopack HDD Hard case/cover/ Pouch with Shockproof Lining for *.* Inch Portable Hard Drive-Black ( to be sold by Vsalesonline) And another item was Seagate Backup Plus Ultra Slim * TB Portable Drive (Gold) with free Seagate Rescue-* year Date recovery plan (to be sold by :Cloudtail India Private Ltd. ) My Amazon.in Orders were of dated **-**-**** i.e. ***-*******-******* & ***-*******-******* . The complainant has made online payment of Rs.**** as per price list displayed on web site of opposite party through his bank account Account no. *************** with banker Punjab & Sind Bank Kalwanoo Branch District Patiala, for the purchase of above said items. The amount of Rs.**** has been debited from the account of the complainant on dated **-**-****, but till date neither the online delivery of the above said purchased items has been made nor the amount has been refunded in the account of complainant. The complainant lodged a complaint with opposite party for non delivery of goods, but the opposite party made a false excuse that they had not received payment. Opposite party through Meenakshi S Amazon.in sent reply to the complaint lodged by complainant wherein it has stated that "your payment failed" and also mentioned therein that "If money has been deducted from your bank account, it will be refunded in *-* days", but till date neither payment refunded in account of complainant nor goods so purchased has been delivered to the complainant, whereas the amount has been debited from the account of complainant. The opposite party in reply to another complaint lodged by complainant with opposite party has given again a vague reply through Meenakshi S Amazon.in that "in case amount is not credited to your Bank account I request you to please contact your bank and raise a charge dispute for the transaction stating that beneficiary has not received the amount". The complainant contacted his banker and the Account statement issued by bank for the period of *-*-**** to *-*-**** shows that amount of Rs.**** has been debited on **-**-**** and no refund has credited therein till date. Also the bank has supplied their details for successful transaction and has given transaction I.D. number POS/ BDR*****/ ************ and reference no.****************/******. The opposite party is harrasing the complainant,
Hence the present complaint with consumer forum Patiala has been lodged for deficiency in service and unfair trade practice on the part of opposite party with a prayer for making an order for the refund of amount of Rs.**** alongwith exemplary cost of Rs.**,*** against the opposite party on account of damages for financial loss and mental agony.
