Security Deposit of *****/- not returned even after * months. Attaching all the documentary evidence for the same. I want the entire money with interest back Nestway has illegally held back my refund for almost * months of *****/-. According to the agreement, attached here, the deposit was to be returned within ten days. Quoting the clause here. "The Security Deposit shall be held by the Owner or its Authorized Representative, during the period of License and shall be returned within ** business days through the authorized representative from the day of vacating the Scheduled Premise subject to the applicable deductions, if any, as set out in Annexure B." I have never dealt with the owner. All the rents and deposits were directly sent to Nestaway. Nestaway is not citing that the delay is due to the Owner not giving back the deposit
This is the reply given by Nestaway on INGRAM portal:
Dear Tenant, we regret the inconvenience caused! With regards to your refund following are the details:- Partial amount Processed(If any) -NA Pending Amount-***** Owner Recovery Pending(Y/N)-Yes Deductions (If any)-PAINTING_CHARGES(****), MAINTENANCE_MOVE_OUT_CHARGES(****). As informed to you and stated in your agreement, the deposit resides with the owner during your stay - we collect it and pass it on to the owner at the time of your move-in. Upon your move-out, our job is to submit a settlement report to the owner and advise any valid deposit deductions as per company policies. In your case, we haven't yet received your security deposit from the owner, which is why the refund is pending. We, on your behalf, are following up to recover the amount, however the owner is taking time to refund it. Once we receive it from the owner, we will process your refund. Your patience in this matter is highly appreciated. Please note, we will keep you posted on your ticket CC_********.
