subject: cancellation of the cab at departure time without prior notice on a fully paid booking
dear makemytrip legal team:
i serve on you this ‘legal notice’, informing you as follows:-
*) that, i had a confirmed cab booking from makemytrip for outstation travel for which the complete payment (****/- indian rupees only) was made to makemytrip for the travel prior to the date of journey i.e december **, ****
*) that, basis the confirmation received after payment, customer planned his trip to coorg and mysore from bangalore and the cost of accommodation, sightseeing etc. was fully paid to the respective hotels.
*) that, makemytrip shared the driver and cab details * hours prior to the start of journey i.e. *:** am on december **, ****. customer called up driver and the driver confirmed his availability at **:**am on december ****
*) that, customer tried reaching driver at **:**am twice but the call went unanswered followed by a message from the cab driver. attached herewith the screenshot. driver denied to come for the trip and informed me to get in touch with makemytrip.
*) that, driver has stated in his message that makemytrip has not paid his previous trip payment, thus he is unable to serve the booking.
*) that, customer reached out to makemytrip customer support wherein he was informed that driver has denied this booking at last moment. makemytrip offered the customer full refund along with ****/- inr compensation.
*) that, customers has all the call recordings of makemytrip support where customer service executive has agreed makemytrip's fault. evidences will be shared upon request.
*) that, customer's trip was screwed by makemytrip and customer requests for complete compensation for the following (supporting documents and bills will be shared upon request)
a) accommodation booked in mysore - **** inr
b) accommodation booked in coorg - **** inr
c) return flight ticket from bangalore to udaipur - **** inr
d) onward flight ticket from ahmedabad to bangalore - ***** inr
in view of the circumstances mentioned above, you are hereby called upon to make the
payment of rs. **,*** (twenty six thousand two hundred forty six rupees only)- within seven working (*) days from the receipt of this notice. please note that in the event you fail to make the payment, on the expiry of seven (*) business days from the date of receipt of this notice, i would have peremptory instructions to initiate civil and
criminal proceedings against you, which would be entirely at your risk, cost and consequences thereof.
in addition to this
a) i reserve the right to report this to national consumer disputes redressal commission
b) share the complete incident along with evidences on social media platforms such as facebook, twitter etc
c) file a recovery case of interest on the delayed payment from the date of the actual payment date.
