HYUNDAI - Replacement of the Defective Tyre RR with New Good Piece Tyre for Hyundai Xcent Car Registration N

Dear Sir/ Ma'am,
Greetings of the Day......

My submissions are as following:

*. I purchased a new Hyundai Xcent S Car from Pawan Hyundai (Pawan Autowheels Pvt. Ltd.) Ghaziabad on **th January, **** bearing Chasis No. MALA***CLKM******, Registration No. UP**CM ****. Retail Invoice with Service Slip and Insurance enclosed.

*. When the Car run approx. **** Km., its Right Rear Tyre got defective on **th February, ****. I contacted Pawan Hyundai Service Centre, Ghaziabad and explained the problem. I send the Car to their Ghaziabad Workshop on **th Febuary, ****.for first free service and replacement of Tyre.

*. Their Workshop Executive told me telephonically to talk with Apollo Tyre for replacement of Tyre.as Tyre could not be corrected.and Apollo Tyre is a third party vendor for providing service related to Tyre.

*. On the same day i.e. **th Febuary, ****, I lodged complaint about the problem with Hyundai India and Apollo Tyre Customer Care through Social media on their Twitter Handle and Telephonically also.

*. I was assured by both Company's Customer Care Executives that they have forwarded my complain and concern team will resolve the issue very soon on priority basis.

Later on Pawan Hyundai Executives denied for Tyre replacement and said it is not covered under warranty of Car, although they forwarded my complain to Apollo Tyre. They returned my Car without Tyre Replacement on **.**.**** in Evening.

*. I received a call form Apollo Tyre (Mobile No. ***********) on **th February. **** that my problem will be solved soon and there after I received a Call again from Mr. Deepak Kushwaha of Apollo Tyre (Mobile No. ***********) on **th February, **** at **:** a.m.. He told me that my Tyre will be inspected by him at Authorised Centre.

*. When my Tyre did not inspected from Apollo Tyre till **th February, ****, I contacted again with Mr. Deepak Kushwaha of Apollo Tyre for inspection of Tyre (Mobile No. ***********), he told me that Reply has been send to Pawan Hyundai Dealer directly through E-Mail.

*. I contacted with Pawan Hyundai, Ghaziabad on **th February, **** , their Executive informed me that claim has been rejected from Apollo Tyre. He send me the copy of rejection letter with Technical-Inspection-Report, Dated: ****-**-**. (Copy Enclosed)

*. I am surprised that without inspection of Tyre, Technical Inspection Report submitted and Claim has rejected by saying that "It is our motto to give customer satisfaction an outmost importance, however we find ourselves unable to process your request for replacement under warranty period as the same doesn’t fall within the prescribed parameters of warranty policy.i.e. Manufacturing defect.".

Whether such fake report is based on presumption only or such Denial/ Negative Reply always ready for all customer as per Company's policy without any inspection of Tyre???
Whether 'your motto to give customer satisfaction' is fulfilled???

**. I again posted my grievances on Twitter Handle of Apollo Tyre Ltd. and Hyundai India, Apollo Tyre reopened the case due to my dissatisfaction. Mr. Deepak Kushwaha of Apollo Tyre called me today on **st February, ****, and as per his instruction I deposited the Tyre to Shri Laxmi Tyres, Tugalpur, Greater Noida (Mobile No. **********) for Apollo Tyres Ltd. F-*, Sec. **, Noida today on **.**.****. Complaint Docket Copy Enclosed.
On **.**.****, Mr. Deepak Bhardwaj called me and said he has inspected Tyre with the help of water and there was no leakage in Tyre. I was surprised and it was unbelievable how it is possible? He send the Tyre back with new fake report to Sri Laxmi Tyres Greater Noida.
On **.**.****, I went to Sri Laxmi Tyres and requested him to show me that there is no leakage in Tyre. When Apollo Tyre Service Center Executive checked it in front of me, he found that Leakage is present in Tyre. He did treatment of Tyre with new Mushroom Puncture but Tyre could not be corrected.
I and Sri Laxmi Tyres Greater Noida informed the whole incident to Mr. Depak Bhardwaj.
It means that Mr. Deepak Bhardwaj was telling lie and again prepared fake report with new false comments after reopening of case.
Now Mr. Deepak Bhardwaj is saying he can not change Tyre and use it with Tube. Very bad Experience.....

I have documentary evidence and Audio Clips/ Video Clips of whole incident.

**. I want to request you kindly read once Apollo Tyre warranty policy:
*. Tyres shall be covered under warranty against defect in workmanship and materials only.
*. Tyres shall be covered under warranty for manufacturing defects for a period of * years from the week of production or date of invoice or till the exposure of Tread wear indicator, whichever is earlier.
(Please provide me definitions of "defect in workmanship and materials only" and also provide details about "manufacturing defects" where explained?

A Tyre which got defected within a month of New Car Purchase (only **** Km. driven) and also it could not be corrected.
Definitely it is defective goods product with poor quality material supplied to bonafide customer and it is also deficiency in services under the provisions of Consumer Laws.

I have suffered a lot more harassment from Hyundai India and Apollo Tyres Ltd. side. Such Defected goods and deficiency in services can not be expected from Hyundai India and Apollo Tyres Ltd.
Hyundai India and Apollo Tyres Ltd. both are responsible for above incidents but both are shifting their liabilities on each-other. It is Unfair Trade Practice and harassment towards customer/ consumer.

I. therefore, request to you kindly see the matter on priority basis and replace the Defective Tyre with New Good Piece Tyre immediately without any cost and harassment. I could not use my Car for going to Office from last ** days.
They should also pay compensation for harassment.
Waiting a prompt reply from yourside.....
