Incident Description:

I had entered into an agreement with Trivial Chapter on **rd September **** for professional consultancy and assistance in securing a job offer in Italy and facilitating the associated visa process under their so-called “European Residency Program”.

As per the terms of the retainer agreement, I made the first installment of Rs. **,***/- on **st September ****, against a total proposal amount of Rs. *,**,***/-. The agreement clearly stated that the total process time including visa processing would be *–* months.

However, despite the expiry of this period (March ****), no job offer, visa assistance, or service of any kind was provided. The company failed to perform any of its contractual obligations and maintained poor communication throughout.

I made numerous attempts to contact the company, including written follow-ups and grievance emails, but received no satisfactory response. On **th April ****, Trivial Chapter sent me a “settlement offer” of only Rs. **,***/-, conditional upon signing unreasonable clauses such as agreeing not to post or share any negative comments about them. I rejected this partial and unfair offer and demanded a full refund of Rs. **,***/- as per the initial agreement.

With no response, I filed a formal complaint with the National Consumer Helpline (Grievance Docket #*******) on **/**/****, which was ignored by the company. Subsequently, I filed a complaint with the District Consumer Disputes Redressal Commission, Mysuru on **/**/****.

During the hearing held on **th October ****, Trivial Chapter’s representative and their lawyer agreed before the Hon’ble Commission to refund Rs. **,***/- to me. I accepted the same in good faith, without claiming any additional compensation. The judge recorded the settlement and directed them to make the payment before **st October ****.

However, even after this settlement, the company has continued to impose unreasonable post-facto conditions and is now refusing to process the refund unless I agree to delete all public reviews and sign additional documents that were never discussed in front of the Hon’ble Commission.

This constitutes non-compliance with the court’s settlement direction, as well as unfair trade practice and deliberate harassment of the consumer.

Relief Sought:

Immediate refund of Rs. **,***/- as agreed before the Hon’ble Consumer Commission on **th October ****.

Action against Trivial Chapter for non-compliance with the Commission’s recorded settlement.

Compensation for mental agony and harassment caused by their continued delay and coercive tactics.

A public warning to other consumers against such deceptive practices by Trivial Chapter.
