Nitin Agarwal filed complaint against Spicejet on May 1, 2026
I am filing this complaint against SpiceJet Limited for wrongfully denying a full refund by applying a No Show policy to passengers who were physically stranded in Lachen, North Sikkim due to a documented natural disaster. This is a Force Majeure event and the No Show classification is factually incorrect and legally untenable.

WHAT HAPPENED
On *-* April ****, a major road breach occurred near Tarum Chu Bridge on the Lachen-Chungthang road in North Sikkim due to heavy snowfall and landslide activity. All * passengers were among approximately *,*** tourists physically stranded in Lachen. The Mangan District Administration issued an official advisory restricting all civilian movement. It was physically impossible and legally restricted to travel from Lachen to Bagdogra Airport on * April ****.
On * April ****, I formally wrote to SpiceJet at nodalofficer@spicejet.com and custrelations@spicejet.com citing Force Majeure, attaching news reports and the district advisory, and requesting a full refund.
On * April ****, the Indian Army launched Operation Him Setu to evacuate approximately *,*** stranded civilians from Lachen via Dongkya La Pass at **,*** ft. This is formal Government of India acknowledgment that no civilian could exit Lachen voluntarily on * April ****.
I hold official Lachen Inner-Line Permits for all * passengers confirming our physical presence inside the restricted zone.
SPICEJET RESPONSE - WRONGFUL DENIAL
SpiceJet responded on ** April **** via email (Case ********) and classified all * passengers as No Show. SpiceJet refunded only statutory taxes. SpiceJet did not engage with or address the Force Majeure evidence at any point in their response.
WHY THIS IS WRONG
*. A No Show requires that a passenger had the ability to reach the airport and chose not to. That condition did not exist here.
*. The DGCA Passenger Charter prohibits airlines from forfeiting tickets when non-travel is caused by a natural disaster beyond the passenger control.
*. Section ** of the Indian Contract Act renders obligations void when performance is made impossible by an act of God or natural calamity.
*. SpiceJet applied a blanket policy without reviewing the Force Majeure evidence - this is a deficiency in service under the Consumer Protection Act ****.
I have also escalated to the Appellate Authority at SpiceJet and filed a grievance on DGCA Air Sewa portal. None have provided a satisfactory resolution.
RELIEF SOUGHT
*. Full ticket fare refund for all * PNRs: RJ*JSK, ZHQISA, and VIQK*X
*. Compensation for mental agony, harassment, and out-of-pocket losses caused by this wrongful denial
