Dear Sir/Madam,
I am issuing this legal notice regarding the unreasonable delay in refund of my flight booking made through your platform Happyfares.
Booking Details:
- Booking ID: HBCC**FO
- PNR: PYYJXK
- Airline: Air India
- Date of Cancellation: ** Dec ****
- Refund Amount: Rs*****
The above flight was cancelled, and despite repeated follow-ups, the refund has not been credited to my account even after ** days, which is completely unreasonable and amounts to deficiency in service under the Consumer Protection Act, ****.
I have been informed that the delay is due to airline approval. However, as a customer, my contract is with Happyfares, and it is your legal responsibility to ensure timely refund of the amount collected from me. You cannot hold my money indefinitely without providing a clear SLA or written proof of airline delay.
This prolonged delay has caused me mental harassment, financial inconvenience, and loss of trust, for which you are legally liable.
Therefore, I hereby demand:
*. Immediate refund of ₹***** to my original payment method
*. Written confirmation of refund processing
*. Compensation for harassment and inconvenience
If the refund is not credited within * days from receipt of this notice, I will be constrained to initiate legal proceedings before the District Consumer Disputes Redressal Commission and also escalate the matter to DGCA / AirSewa, entirely at your risk as to cost and consequences, without any further notice.
This notice may be treated as a final opportunity to resolve the matter amicably.
