Magicbricks - Refund denied despite the company having promised FULL REFUND

Subject: Denial of refund of INR **,*** from Magicbricks despite the promise that "full refund, no questions asked, if not satisfied"


Dear Sir, Madam,

Namaste and greetings!


My name is Deepak Joshi and I am addressing this email to you in relation to a complaint about Magicbricks’s services.

I got involved with Magicbricks via Mr. Himanshu Dixit (Phone **********) of “Magicbricks Property Legal Services Team”. The services regarding which Mr. Dixit approached me (via Phone, WhatsApp, and email) were about legal services related to purchase of a property and included combo pack.
(See annexure PDF File – email from Mr. Dixit to me on ** November ****, *.** PM).

Finally, after a few rounds of discussions with Mr. Dixit, the price was negotiated to **,*** for combo pack. This included Introduction call, Legal title check of the property, Drafting of Agreement to Sale, Drafting of Sale Deed, Transfer of memorandum (TM) etc.

After this, Mr. Dixit sent me the payment link on Whatsapp:

Subsequently, I made the payment and received the invoice as below:

Now, Mr. Himanshu Dixit on multiple occasions had promised to me that should I not be satisfied with the services, there will be ***% refund, no questions asked (annexures attached below)

On **-November-****, when I discovered that Magicbricks services were not up to the mark, I formed Mr. Himanshu Dixit that I am not interested in availing the services any longer and would like the refund (annexure attached). By this time, the only service I had availed was “Agreement to Sell”. As a fair customer, I even offered him to deduct the charge of “Agreement to Sell” and refund the remaining amount (although his promise was for full refund, no questions asked).

It has been more months since then.

On **-December-****, I filed a complained with the grievance officer of Magicbricks (grievance@magicbricks.com). Email attached as evidence.

They denied my refund request on ** December ****, saying I was not eligible for refund. (Email attached as evidence.)
It baffles me why then Mr. Himsnshu Dixit had promised me “full refund, NO QUESTIONS ASKED”. (As evidence, see IMAGE * and IMAGE * above wherein Mr. Himanshu Dixit promises FULL REFUND, NO QUESTIONS ASKED)

This is when I am not even asking for full refund (which was Mr. Dixit’s assurance to me when making the sale). I am fine with the “Agreement to Sell” charges being deducted from the refund.

May I please request you to intervene. Magicbricks should refund my money as:
A. They did promise full refund if I did not like the services
B. I did not even take all the services promised. Only * service - “Agreement for Sale” was availed.
