Route: Warsaw (WAW) to Hyderabad (HYD) via Sharjah

Date of Incident: November **-**, ****

Passengers: * (including a *-year-old infant)

*. THE CORE VIOLATIONS A. Involuntary Denied Boarding (Article * EC ***/****): Despite having confirmed tickets, my family was denied boarding at the connection in Sharjah. The flight operated, but our specific seats were given to other passengers. The airline falsely claimed "Fog/Weather" to deny compensation, even though the flight departed with other passengers in our seats.

B. Downgrading & Breach of Contract: When finally put on a replacement flight ** hours later:

Seat Downgrade: I paid for Extra Legroom Seats *A & *B (Premium). I was forced into Standard Seats **D & **E.

Service Failure: Pre-booked meals were not provided. Despite informing the crew of our severe dehydration, we were served last and forced to eat leftovers.

*. GROSS NEGLIGENCE & PHYSICAL TORTURE (Article * & Montreal Convention) The airline committed a gross violation of its "Duty of Care" during the **-hour delay:

Refusal of Shelter: Staff explicitly refused hotel accommodation.

Inhumane Conditions: My family, including a *-year-old infant suffering from active diarrhea, was forced to sleep on the cold, hard terminal floor for ** hours.

Denial of Essentials: Staff and security actively avoided our pleas for help and rejected requests for basic supplies (pampers/baby food).

Medical Consequences: As a direct result of sleeping on the floor and exposure to cold/unsanitary conditions, my wife and I are now undergoing medical treatment for severe Viral Flu and Respiratory Infections, and my infant's health has deteriorated.

*. IGNORED COMMUNICATIONS I sent formal legal notices to Air Arabia on November **, **** and December *, ****.

The airline responded with a generic template blaming "Fog" (Force Majeure).

They failed to address the Denied Boarding (operational overbooking) and ignored the medical negligence claims.

They have failed to pay the statutory compensation within the deadline.

*. FINAL RELIEF SOUGHT I am requesting Voxya to file a formal Legal Notice and, if necessary, a Consumer Case in Hyderabad, demanding:

€*,*** Statutory Compensation: (€*** x * passengers) for Denied Boarding.

€*,*** Damages: For mental agony, physical torture, and medical costs arising from the negligence.

***% Refund: Of all Seat Selection Fees.

TOTAL SETTLEMENT OFFER: I am willing to settle this entire dispute immediately for a lump sum of €*,*** (approx. ₹*,**,*** INR) plus seat refunds. Failure to pay will result in litigation for maximum punitive damages.
