AJAY SHARMA filed complaint against Swiggy on May 21, 2019
I had placed an order for “Mixed Veg in Hot Garlic Sauce Combo x *” from restaurant China Gatherings DLF Phase * Ggn vide order No. #*********** via swiggy App on */*/**** at *.** pm. I ordered this meal for my regular lunch from swiggy and I am a member of swiggy super (Swiggy’s Membership). But I was in the situation of the shock after spotting some chicken/meat pieces in shape of balls there was no vegetable in the entire preparation. It was a total mix-up of some fried non-vegetarian ball. The same has been on the basis of the doubt has been checked by one of my colleagues and found confirmed as non-vegetarian items. I puked immediately after knowing the fact of the non-vegetarian food in front of me.
I am a Hindu Brahmin (by religion & caste) and pure vegetarian since birth. I am not supposed to even get in contact with non-vegetarian food as per the belief and practices of the religion to which I belong. One can’t imagine that situation of the guilt, disgust & uneasiness for the moment which violated all my religious practice and belief.
I am feeling irritated and uneasy since that moment and haven’t my lunch or dinner yesterday, due to such a horrible experience. The incidence happened due to the gross negligence from the restaurant as well as swiggy, which results in me in the nauseous situation due to a confrontation with non-vegetarian (in the meal) for the first time in my life without my consent.
I reported the issue to the swiggy and I am not satisfied with the action taken and their response time. Swiggy has not even bothered to visit my place to have a look at the fact of the delivery of non-vegetarian food.
Swiggy being a service aggregator has a responsibility to mediate any of the disputes in a prompt and appropriate manner. I have paid to both i.e. swiggy & restaurant, in the form of the membership/delivery fees to Swiggy and in the form of consideration to the restaurant. So nobody can’t escape from the legal consequences arising out of this incidence.
I have suffered an irrevocable loss on the ground of physical, emotions, and religious sentiments, which is a matter of serious concern. Therefore, I strictly demand a regressive penal action against restaurant (in form of termination of listing of the restaurant from the online portal and monetary compensation too) as well as against Swiggy for the negligence of matter of serious concern.

The development in the case is that no response since that day from any of either Swiggy or restaurant and even FSSAI. So I am proceeding with the filling of a legal suit.
