On ** th sep **** at *.** PM, when i opened my gpay account i received a pop up msg, mentioning that basis my last transaction i have won a scratch card and upon scratching the same the credit will be passed on to my account.
Accordingly I scratched the card and found that Rs **** was awarded to me as a cash back. As in routine this time also, Gpay asked me whether the credit should go in to my gpay account or to my bank account. I selected my bank account. Upon selecting my bank account instead of crediting the amount to my bank account it debited my account.
In a second, I received the following msg from my banker " "RS****/- was debited from a/c****** on **-**-** to a/c****** (UPI Ref no.************) .".
This is absolutely a fraud that has happened in my bank account through gpay account with the involvement of gpay. The amount has gone from bank account which was not authorized by me.
This is a clear breach of agreement done by gpay as gpay has knowingly or unknowingly parted my sensitive KYC account details to a fraudster without our concurrence and that has helped the fraudster to steel the money from my account.
Below are the breaches as we see,:
a) Google Pay is classified as Third-Party App Provider (TPAP) and also provides UPI payment services, working through banking partners and operating under the UPI framework of NPCI, and it is expected to keep the customers sensitive information very confidential, whereas, it has failed from it duty by parting my information to a fraudster. Else how would the fraudster know my phone no and other details to popup a fraud in my mobile.
b) All TPAP’s are already bound by full compliance to all the regulations and applicable laws in India. UPI eco system which is supposed to be fully safe and secure has missed its credential by parting my sensitive information to a fraudster.
c) Gpay has cheated & misguided me as it has mentioned as one of its unique features as “Scratch cards are another attraction as Google Pay provides lucrative cash backs and offers on varying transactions. These cash backs are directly credited to a linked bank account “ that has actually misguided us.
d) In contrary to what Google Pay said that, all transactions made through its platform are fully protected by redressal processes laid out in the guidelines issued by the Reserve Bank of India and the National Payments Corporation of India. There is no redressal process available in the platform, even the escalation matrix is not available in the website. When toll numbers are contacted, due to Covid ** directing us to write a mail, but no mail address is provided.
e) Despite of gpay confirming that “Transactions using Google Pay are secure as Google keeps all payment information in secure servers. Your full card/phone no/bank details are never stored on your phone or shared with merchants when you use Google Pay. Merchants are only provided with your Virtual Account Number”, however gpay has parted my confidential information to a fraudster, by which the fraudster has peeped in to my account to stole Rs****/-.
Iam providing an opportunity to you to explain, as why I should not file a complaint with the police for this fraudulent transaction encouraged by gpay, and also with RBI, and file a consumer case against Gpay for the mental agony we have under gone and seek a remedial compensation from you.
I got my refund. You guys have really helped me when I needed it the most! Thanks again for your help :-)
