*. Background: I purchased a MarQ refrigerator valued at Rs**,***, which became non-functional
while under warranty. The defect identified was with the compressor, which carries a longer
warranty of * years.
*. Failure of Repair Attempts: The technician visited twice and installed an incorrect compressor
both times. He also admitted that the company did not have the exact compressor, so they were
sending an incompatible one. As expected, the refrigerator did not function. An independent expert
confirmed the refrigerator works correctly when a compatible compressor is used.
*. Warranty Evasion by Opposite Party: Despite the compressor being under warranty, the
company incorrectly classified the issue as “Out of Warranty” after three months of delays, wrong
repairs, and no resolution. They then offered an unjust depreciated refund of Rs*,***.
*. Deficiency in Service: - Failure to repair a warranty-covered component. - Installation of incorrect
compressors. - Three months of unresolved service requests. - False OOW classification to evade
responsibility.
*. Unfair Trade Practice: - Selling a product without ensuring spare parts availability. -
Misrepresenting warranty conditions. - Offering an unreasonably low refund to avoid warranty
obligations.
*. Relief Sought: - Full refund of Rs **,*** + Rs **** for service charge for Compensation for mental harassment and
inconvenience. - Reimbursement of external inspection costs. - Litigation costs. - Directions to
prevent such practices.
I request the Commission to take necessary action and provide appropriate relief.
