Details of the Complaint:
I, Kashipathi V, enrolled in a course provided by PlanetSpark on December *th, ****, after paying a total amount of ₹**,***. The payment was made in two parts:
- ₹*,*** via UPI
- ₹**,*** via Credit Card
This payment was made based on assurances from PlanetSpark representatives about the course quality and its suitability for my requirements.
Issues Faced Post-Enrollment:
- Curriculum Mismatch: The curriculum provided by PlanetSpark appears to be designed for children, which does not meet my expectations or needs.
- Mismanagement of Classes: I received multiple conflicting and false reminders regarding class schedules.
- On several occasions, I logged in for scheduled classes only to find them cancelled without prior notice, citing holidays or other reasons.
Lack of Transparency:
- During the enrollment process, the refund and cancellation policies were not disclosed, despite specific inquiries.
- Repeated requests for a refund have been denied, without addressing the deficiencies in their service.
- These issues amount to deficiency in service and unfair trade practices, causing financial loss and mental distress.
Legal Violations by PlanetSpark:
- The actions of PlanetSpark violate the following provisions under the Consumer Protection Act, ****:
- Section *(**): Deficiency in service due to non-performance of contractual obligations.
- Section *(**): Unfair trade practices, including misrepresentation and omission of critical terms like refund policies.
Relief Sought:
I humbly request the platform to direct PlanetSpark to:
- Refund the full amount of ₹**,***.
- Pay compensation of ₹**,*** for mental agony and harassment.
- Reimburse the cost of filing this complaint and any incidental expenses. (if any)
