Flipkart. com - incomplete package

i have purchased vivo v* + black ** GB internal memory with *gb ram from flipkart cost is *****, ,the courier person has delivered the box ondated **-**-****, he came across the road and give me the box, but it was not in a good condition ,after half an hour when I opened the box i found my vivo v*+ mobile phone missing but there was charger, ear phone, bill and a small pin to open the sim slot, ihave called flipkart and raised complain regarding all these things, first off all they have told that they will look after my problem and send me a new phone , but today they have told that neither iwill get back my money back nor i will get the phone, so plz help me
