I am writing to formally lodge a complaint against Flipkart regarding their failure to replace a defective product as per their policy. I purchased an Asus TUF Gaming laptop from Flipkart for INR **,***, and despite multiple requests for a replacement, Flipkart has consistently delayed and denied resolution, which I believe constitutes unfair and fraudulent practices. It has now been over ** days since I first reported the issue, and I have not received any satisfactory action or communication.
Details of the Issue:
*. Product and Delivery Details:
- Product: Asus TUF Gaming Laptop
- Purchased from: Flipkart
- Order Value: INR **,***
- Delivery Date: **th October
- Delivery Method: Open box, with inspection limited to physical damage
*. Issue Identified:
- Upon powering on the laptop after initial setup, the screen was found to be completely non-functional. Although keyboard lights and startup sounds were active, the screen remained blank.
- This issue was confirmed during an open-box delivery inspection, but since it was limited to physical damage only, I was not permitted to power on the device before acceptance.
*. Attempts to Resolve:
- I immediately contacted Flipkart on the day of delivery, and they advised me to request a return. I was initially assured a replacement within * days.
- Despite this, Flipkart has repeatedly delayed the replacement process, stating that I would receive a callback from their technical team within ** hours—a commitment that has been made and broken multiple times over the past ** days.
- On the rare occasions I could escalate the issue, calls were disconnected, and no resolution was provided.
*. Involvement of Asus:
- At Flipkart’s request, I contacted Asus, who sent an engineer to inspect the laptop. After five days, Asus informed me that the laptop’s LCD screen was damaged due to pressure, making it ineligible for a free repair or replacement.
- Furthermore, Asus representatives, during a phone call, were dismissive and stated that the responsibility lay with Flipkart as the product was delivered by them.
Violation of Flipkart's Policy:
According to Flipkart’s stated policy, any faulty product should be eligible for replacement within * days of delivery. However, I have now been waiting for over ** days with no replacement, repair, or concrete resolution in sight. Flipkart has failed to comply with their replacement policy, leaving me with a non-functional product, wasted time, and no clear recourse.
I request that the Consumer Court directs Flipkart to:
*. Immediately replace the defective laptop: with a new, fully functional unit, or provide a complete refund.
*. Compensate for the time, energy, and resources I have expended in attempting to resolve this issue over the past ** days.
*. Investigate and take necessary action to prevent future instances of similar deceptive practices.
