Subject: Complaint against NoBroker Technologies Solutions Pvt. Ltd. for Deficiency in Service, Unfair Trade Practices, and recovery of financial losses amounting to ₹*,**,***/-.
*. Facts of the Case:
• Booking Details: I, Akshansh Dwivedi booked "Movers and Packers" services through the NoBroker platform on ** april **** more than a week prior to the scheduled shifting date of *st May ****. A token advance of *** was paid and acknowledged (Booking ID: HSPM:********
• The Incident: On the scheduled date and time of ** AM the service provider failed to arrive. Despite multiple follow-ups via phone and chat, I was kept in the dark for four hours past the scheduled slot.
• Negligence: It was only after four hours of delay that NoBroker summarily informed me they could not fulfill the service. No prior notice was provided, depriving me of the window to arrange an alternative service.
*. Grounds for Complaint (Deficiency in Service):
The Opposite Party (NoBroker) exhibited gross negligence and unfair trade practices by:
• Failing to provide the service after accepting advance payment.
• Failing to provide reasonable notice of cancellation (**-** hours), which is standard industry practice.
• Willful disregard for the consumer's time and financial commitments.
*. Financial Losses & Damages:
Due to the Opposite Party's breach of contract, I have incurred the following losses:
• Landlord Penalty: As I had committed to vacating the premises, I was forced to pay one month's rent as a penalty for overstaying/breach of contract, amounting to *****
• Employment Loss: I had to take two days of unplanned leave from work, resulting in a loss of pay/productivity.
• Emergency Shifting Costs: Since I had to move immediately, I was forced to hire a last-minute service at a significantly higher market rate.
• Mental Harassment: The uncertainty and sudden failure of service caused extreme mental agony and stress.
*. Prayer / Relief Sought:
I request this Hon’ble Commission to direct the Opposite Party to:
*. Refund the initial advance payment in full with **% interest.
*. Pay a sum of ₹*,**,***/- towards the actual financial losses incurred (Rent penalty, loss of pay, and increased shifting charges).
*. Pay a sum of ******/- as compensation for mental harassment and litigation expenses
