ANUSHKA VERMA filed complaint against Spicejet on Apr 13, 2020
Had booked a ticket for DEL-AHD for **nd March with departure time *:** PM. PNR:- RDFE*D and NCWQ*T
At **:** PM the previous day i.e. **st March I am called by a number from Spicejet Customer Care saying my flight has been CANCELLED and that I will get the money refunded in a couple days.
So I unpack, book whichever alternate tickets I could find at that time (which were RS **** more expensive might I add) and went to sleep.
At around *:** AM and *:** AM on **nd March in the middle of the night I receive two SMSes from Spicejet saying that my flight has been preponed all of a sudden instead. Preponed to *:** AM in the morning.
They dont call me like they did just * hrs before for the cancellation, they just send an SMS in the middle of the night that I am supposed to miraculously wake up and read.
By this time, I had already been called and told by a representative that it was cancelled and would be getting my refund, I had booked alternate tickets and was fast asleep.
In the morning after waking up and on checking my phone I notice the SMSes.
I immediately call Spicejet Customer Care and inform them that not only was I called at ** PM by their representative that my flight was cancelled but also how am I supposed to read an SMS sent in the middle of the night when I’m asleep for a flight that literally leaves in a couple hrs early morning *:** AM.
They apologise and say that as the cancellation/rescheduling is all their fault they will be refunding my amount to my mode of payment in a couple days.
Almost a week passes and I still haven’t got my refund so I call again and am told the same thing as above.
I wait another week and then I write them an email detailing the entire thing.
They then say that they will not refund but will credit the money to a CREDIT SHELL.
But on going to their website and entering my PNR I am not able to see any money in the Credit Shell they talk about.
Also the website clearly states that the CREDIT SHELL system is for bookings from **th March i.e. from the day of the lockdown start.
I have emailed them multiple times regarding this now but they have literally stopped replying.
My entire booking amount of RS. ***** is stuck with them and they are refusing to pay me back.
Instead lying and giving false hopes about CREDIT SHELLs.
I have written to their Customer Care, Nodal Officer and their so called Appelate Authority but they are not replying as well.
Their customer care phone number is down so I can’t call anyone and talk to them.
HOW IS ALL THIS FAIR OR LEGAL ??
According to their own Terms of Service I deserve a full right to have a refund.
Based on their TOS Section ** Sub-section * I was literally informed less than **hours before my flight and wasn’t offered an alternate flight and nor was I refunded my paid amount.
So, according to their TOS Section ** Sub-section * I am entitled not only to a full refund of my fares but also additional compensation of INR *,*** per person.
I don’t care about the additional compensation but these guys are not even refunding me the money I paid in full for a flight they cancelled/preponed at the last minute in the middle of the night.
I just want my money refunded to my original mode of payment. No CREDIT SHELL and no gimmicks.

My two years of blood & sweat got valued finally with Voxya. I got a full refund with no hustle after they received notice.
