DAULAT HUSSAINALI BISHUN filed complaint against GODREJ PROPERTIES LIMITED on Apr 18, 2022
I came accross a project known as ‘Godrej Sky’, in Byculla being developed by M/s.GODREJ PROPERTIES LIMITED (Office Adress: * th floor, Godrej Tower, Eastern Express Highway, Vikroli (East)Mumbai- ******).
I was then further informed that I have booked flat No. **** on **th floor (i.e. *th Habitable Floor) of the project Godrej Sky by admeasuring approximately **.** sq. mtrs equivalent to ***.*** sq.ft. tentatively, with a view of podium amenities and Byculla Zoo situated at South Mumbai Byculla next to Jijamata Udhan Ghorupdeo road, Mumbai ******, for total cost of Rs. *,**,**,***/- (Rupees Three crore, fourty-eight lakhs, ninety-one thousand, seven-hundred and eighty-eight Only).
I further states that accordingly, based on the said emails, I paid entire **% consideration i.e. Rs. *,**,**,***/- (Rupees One Crore Seventy Four Lakhs Thirty Eight Thousand Two Hundred and Sixty Seven Only) for the purchase of the suit flat and apart from transferring the said amount of Rs. *,**,**,***/- (Rupees One Crore Seventy Four Lakhs Thirty Eight Thousand Two Hundred and Sixty Seven Only) I have also paid Rs. *,**,***/- as a TDS to income tax authority who in turn, has issued the receipts in the name of R.R. Builders in my favour along with the TDS amounting to Rs. *,**,***/- with the PAN number of the deductor: APFPB****G.
But due to Demonetization the project was failed and shattered,therefore I kindly bring into your notice that Godrej Properties Limited is illegal as per Section * of Maharashtra Ownership of Flats Act, as they are not entitled to collect more than **% of purchase consideration of suit flat without entering into Written Agreement. The said Letter of Allotment is even otherwise is illegal and not binding upon me as the same has not been issued by Godrej Properties Limited but has been issued by R.R. Builders, with whom I had not privity of contract. Moreover, neither an agreement was registered nor the amount paid by mine has been refunded to me till date.
It is Humble request to look into this matter and call upon the following Godrej Properties Directors along with R.R. Builders.
