Flipkart.com - Received a poor quality product

Hello, I purchase Globalite Men Navy Lime Sandals from flipkart.com and i received it on **nd may. with in ** days the sandals damaged totally. I requested a replacement for that product. Initially flipkart accepted my requested but, pick up boy rejected to pick the product as I was used that product for few days(around * week). I called to flipkart regarding the same issue and flipkart executives said that as per terms and conditions of the product, Once it is used we can't claim any replacement or refund. I agree for that but, how could we know the quality of product without using it and what is the use of ** days of return/replacement policy with such kind of terms and conditions. I called to flipkart regarding this issue many times but they are only saying that as per termas and conditions they can't do anything. After few days my call is automatically getting rejected when I was calling to flipkart. To reach the flipkart I posetd many tweets on twitter but I have'd received and response. So, I thought of taking revenge for this. I bought some other product form my another flipkart account before the purchase of this sandals using flipkart pay later which cost is ****. So I extended repayment of **** and I informed flipkart that I'll refund that amount only after i got justification for my Issue regarding Sandals. Now flipkart sent notified me that it is going to send a legal notice for me so I'm also planning for a legal proceeding for my Issue. I decided to file a case against flipkart for its negligence.
