Ibibo Group Private Limited - PNR REFUND

I booked flight tickets of domestic airlines through travel agent GOIBIBO website , whose PNR is X*L*FM. The due date of travel was on **/**/**** for * passengers to be undertaken from Kolkata (CCU) to Hyderabad (HYD) for medical surgery purposes, but could not be undertaken due to cancellation of return flights amidst COVID** lockdown. The ticket was priced at Rs. ****/- which was deducted by travel agent GOIBIBO, an ecommerce website which deals with travel and tourism itineraries [having registered office at Goibibo Corporate Office Ibibo Web Private Limited, *th Floor, Pearl Towers, Plot No **, Sector **, Gurgaon ******, Haryana website : www.goibibo.com] but I haven't yet received FULL refund in lieu of it. On my request/complaint to DGCA, the concerned airlines approved & granted FULL REFUND in lieu of PNR X*L*FM without levying any cancellation fees or charges as per the judgement of Hon'ble Supreme Court of India in Pravasi Legal Cell & Ors Vs Union Of India & Ors in Writ petition (C) No *** of **** and Writ petition No. *** of **** on **/**/**** & pursuant DGCA Circular No */*/**** -IR dated **/**/****. The said circular of DGCA clearly states that my case falls under Clause * (ii). The approval of AIRLINES is attached herewith, wherein through email correspondences dated **/**/**** they have stated specifically that full refund in lieu of PNR X*L*FM has already been processed by them towards GOIBIBO on **/**/****, but I am yet to receive remaining amount full refund of RS.****/- (ATTACHED) With reference to my grievances through TWITTER official handles, mails, & in NATIONAL CONSUMER PORTAL(******* dated **/**/****) GOIBIBO as respondents did not even care to attend to respond. Since the start of the lockdown, they have closed all customer care numbers all over the country making it difficult to reach them by all INDIANS. Inspite of AIRLINES clearly stating on record vide email that they have processed the said refund on **/**/****, GOIBIBO is clearly in contempt of the directions of Honble Supreme Court Of India, which is further reiterated by DGCA vide Circular No */*/****-IR dated **/**/**** stating : " In compliance with the direction of Honble Supreme Court of India, the travel agent shall immediately transfer the refund amount to passenger & the travel agent can't withhold the refund amount with themselves, once it has been paid by airlines. It is the obligation of the travel agent to immediately transfer the refund amount to the passenger, once they receive it from airline.Withholding of such refunded amount, by the travel agent, in any manner whatsoever would amount to gross & blatant violation of directions of Hon'ble Supreme Court of India." (ATTACHED) Hence, after receiving the FULL REFUND from the airlines, withholding the refund amount in lieu of PNR X*L*FM, GOIBIBO [ having registered office at Goibibo Corporate Office Ibibo Web Private Limited, *th Floor, Pearl Towers, Plot No **, Sector **, Gurgaon ******, Haryana website : www.goibibo.com] has broken laws of the highest court of the land & also the directions of DGCA.So, I am forced to plead you to kindly enumerate strict directions against GOIBIBO for immediately refunding full remaining amount of Rs.****/- in lieu of PNR X*L*FM, which has already been processed by airlines on **/**/**** & warn them with strict action for playing with public money by withholding the refunds amidst pandemic situation.
