Sir/Madam,
I am submitting the following few lines for your kind consideration please.
This is to inform you that I, SUVRA MUKHERJEE have purchased a Honda Activa *** on **/**/**** from RIRONSI AUTOMOTIVE, near Auxillim high school, Nagar-Manmad Road, Savedi, Ahmednagar – ****** with a cost of Rs. *****/- vide Receipt No. ****/RC/***.
I am facing serious problem from the very first day of purchasing the same. This scooty had a start problem (i.e. it could not start in one self). The same problem was told to the salesman (Sarang) over telephone and his reply was that the problem will be solved during *st servicing. Now I have done all the services of the scooty in time but the problem still exists. The scooty was totally stopped and became hang while returning from market within a week of purchasing. I have to return to my residence by walking along with the scooty near about * km which was harassment to me.
I came to know at the time of RTO passing that the manufacturing date of my scooty was November’ **** and I have purchased it in May’ **** i.e. after one and half year of its manufacturing with current market price. I think it is a duty of a salesman to make concern every customer about the product’s manufacturing date as the manufacturing date is not printed on the product. If I was informed before purchasing that the scooty was one and half years old, I never bought the same. It is clearly a matter of ¬clearance of old stock at higher rate to hide the actual fact.
I have complained to Honda vide emails dated **/**/****, **/**/**** and **/**/**** against which two ticket numbers *-*********** and *-*********** had been generated but I have not received any reply in writing till date.
Meanwhile I have received a call on **/**/**** from Mr. Sunil (from Rironsi Automotive) who offered me Rs. *****/- by cheque or RTGS / NEFT in lieu of my Honda Activa *** along with all original documents. On the very next day, (i.e. **/**/****) Mr. Sunil agreed to pay me Rs. *****/- (i.e. the actual cost which I have paid to purchase the old and defective scooty) through NEFT/Online transfer. The matter was well known to the Honda Company as on the same day I have received a call from Ms Sheetal stating that she was calling from Honda who also told me to meet with the dealer along with scooty and all other documents. I told her that I shall be out of station for a week. She advised me to contact with the dealer whenever I return. I have kept all the voice recordings of the said communications.
After trying to fix the meeting time from **/**/**** the time schedule of the meeting was fixed on **/**/**** at *:** pm, and accordingly I along with my friend went there at the scheduled date and time. After waiting one hour, Mr. Sunil came and surprisingly told that there was no option of return though earlier Mr. Sunil and Ms Sheetal from Honda company committed about the return. Then we went to the Director also and he said that he was not aware about the return. Being a Central Government Gazetted Officer, I have no so much time to waste by this type of silly drama. If one precious day had been ruined intentionally in this way, it is amounted so much harassment and mental stress to me.
After that I have complained this to Honda company on **/**/**** and based on the complain a ticket no. *-*********** had been generated on **/**/**** and the same had been resolved on **/**/**** without a single phone call or written reply.
I have forwarded a legal notice with the help of Advocate Shri. Tanmoy Nath, B.A.,L.L.B. to (i) The Manager, Honda Motor Cycle & Scooter, Gurgaon, Haryana - ******, (ii) Western Regional Office, Akurdi, Pune - ******, (iii) The Manager, Rironsi Automotive, Savedi, Ahmednagar - ****** on **/**/**** and the same had been received latest **/**/**** by all the concerned. No reply has been received from their end.
Thereafter I have also forwarded a legal notice with the help of Advocate Shri. Sunil B. Mundada, B.S.L.LL.B. to all the above managers. However, reply has been received on **/**/**** from Shri. Anand R. Firodiya, B.Com, LLB., Ahmednagar. According to him two wheelers do not have any expiry date and denied the aforesaid communication of paying Rs. *****/- in lieu of Honda Activa *** along with all original documents.
In view of the reply of Shri. Anand R. Firodiya, it is not clear that as two wheelers do not have any expiry, any company or showroom may sell */* years old bike to any customer without intimating the actual fact. It means that company is selling old product to hide its manufacturing date. Not only me, any of the customers never buy an old product with current market price. It is the loopholes of the showroom that they did not have new model but it should be informed to the customer before selling an old product. When a customer is paying current market price for a product he should got the latest product. Also as I have all the recordings of the said communications how they denied the same.
In view of the above, I am requesting to look into the matter and do the needful to get back the actual cost of the scooty as well as compensation for harassment as I do not want to continue any relation with that so called dealer (i.e. Rironsi Automotive) after getting this type of cheating / fraudulent behavior.
An early and preferable action is solicited.
