Exotica Inn And Retreat Holiday Pvt Ltd - Misselling of accommodation package and subsequently refusal of services

Sir/Madam,
This is regarding the mis-selling of accommodation package and further, refusal of service by Exotica Inn and Retreat Pvt. Ltd. The sequence of events are reproduced below for humble submission and your kind perusal,
*. On ** November and ** November ****, through call and WhatsApp messages from Riya, **********, I received an invitation on behalf of Exotica Inn and Retreat for my family at Pindballuchi, PP tower, Shop ***-***, *st, NSP, Pitam Pura, New Delhi – ****** for collecting vouchers for * night/* days Holiday, Vibes beauty voucher, and a couple dinner along with the mention “there is no terms and conditions to collect the gifts”. *. I along with my family visited the above mentioned venue on **.**.**** wherein I was informed about the real purpose of the meeting which was to sell an accommodation package for pan India basis with an option for foreign locations.
*. At that point of time, after verbal and written discussions and assurances from Sh. Ali (**********) (Employee Code EIRH****) and his manager, Mr. Anil (***********, **********), I purchased an all-inclusive cost included accommodation package for * years validity with ** days accommodation stay all across India and *N/*D stay on locations outside India for Rs **,*** (which costed me Rs **,***.**/- due to EMI based option opted my me). Further, for any fun activities such as paragliding, water based activity, sightseeing, rock climbing, snow based activity and such type of activities, there would be an AMC charges of ****/- per year (for * days) and further charges on pro-rata basis on availing such services beyond * days. Further, on ** November ****, I received an email on behalf of the company from info@exoticainnandretreat.com informing about the terms and conditions of the package which were mostly in consonance with the package discussed with Mr. Ali and Mr. Anil vide point number *. (One point regarding *N/*D stay on locations outside India was not mentioned but that was written by Mr. Anil on the agreement.) (Annex_C.pdf)

Meanwhile, in between, I received a package through dak containing my membership card alongwith a letter mentioning AMC of Rs ****/- as per usage of the services (by services, I naturally understood it be the services of fun activities as explained to me at point number * above. It is very strange that the AMC part was not mentioned in the email received dated **.**.**** as submitted in point * above). (Annex_D.pdf)
*. To avail the abovementioned services, I emailed Exotica on **.**.**** to avail the accommodation services for Mumbai for * days i.e. * September and * September. (Annex_E.pdf)
*. After the above request, I started to face mental harassment,torture and anxieties regarding my bookings and services. I reminded them time and again for the above booking on ** Aug **, ** Aug **, ** Aug ** and twice on ** Aug ** through email on info@exoticainnandretreat.com; akajayu*@gmail.com. I followed up this constantly over the WhatsApp, call and email with Mr. Pradeep (***********, ***********, ***********), MrKaran Gupta (***********), Mr. KundanBisht (***********), Mr. Ali (***********), Mr. Anil (***********, ***********), Mr. Rajesh, Mr. Nilesh, Mr. Rahul and the directors (searched through internet) Mr. Surendra Kumar and Ms. Richa as well. After facing this treatment, I suffered enough harassment and issued a warning that I would initiate legal action for the same if the booking is not provided on time. Finally, I wrote to Exotica Inn and Retreat to provide bookings otherwise I would initiate legal proceedings. In addition to this, I also issued a warning that if the bookings were not provided in future, then full refund would be issued by Exotica Inn and Retreat. (Annex_E.pdf & Annex_F.pdf)
*. Finally,after much efforts and suffering, the booking vouchers over WhatsApp were provided to me and was informed about the same through email (**.**.****). (Although I could not travel due to medical exigency in the family and transferred the vouchers to my friend’s family). (Annex_G.pdf & Annex_G*.pdf)
*. At present, I requested for bookings to Exotica Inn and Retreat in Jaipur for * days i.e. ** March and ** March **** via email. And I followed up over call and email regarding this regularly and I was assured that I would be provided bookings in due time. (Annex_H.pdf & Annex_H*.pdf)
**. Strangely to my utter surprise, on **.**.**** over call and WhatsApp, I was told that I have to pay AMC mandatorily to avail the services of accommodation package otherwise no services in respect of accommodation would be provided. (Regarding which I was informed at the time of selling the package that it is optional as informed in point * above.) (Annex_I.pdf & Annex_I*.pdf)
**. In continuation to the above, I dropped an email to Exotica Inn and Retreat informing the whole matter. (Also informed through whatsapp). I requested for full refund regarding the same or to find an amicable solution for the matter with the warning that I would be approaching the appropriate forum after this for the resolution of matter. At this point of time, I have suffered enough and therefore, I request authorities to enable me to get a full refund in the case along with compensation for the harassment I have faced.
