Nikhil Kumar filed complaint against KODAK HD LED TV on Dec 5, 2025
I purchased a Kodak CA Pro *** cm TV for ₹**,***, which developed a major defect on * October ****. The TV does not boot and continuously switches on and off on its own, making it completely unusable. I immediately filed a complaint and submitted the invoice. My complaint was registered under Complaint ID: SPRK-BFX*NB-BHGFEK-FWL*QS-*IQW***.
Despite providing all required details and documents on the same day, the Opposite Party Super Plastronics Pvt. Ltd. (SPPL) failed to take any effective action. For more than ** days, no technician visited my home, no inspection was done, and no spare part was dispatched. The company merely kept calling every *–* days with empty assurances and generic responses, without any resolution.
Even after serving a formal legal notice, the Opposite Party continued delaying the matter and still did not arrange any repair or replacement. It has now been over two months, and the television remains defective and unusable. The conduct of the Opposite Party clearly amounts to deficiency in service, unfair trade practice, breach of warranty, and wilful negligence as defined under the Consumer Protection Act, ****.
Due to this negligence, I have suffered severe inconvenience, mental harassment, financial loss, and deprivation of use of the product for an extended period.
CAUSE OF ACTION
The cause of action first arose on * October ****, when the product became defective and the complaint was raised. It continued to arise thereafter due to the Opposite Party’s repeated failure to provide service, refusal to repair or replace the product, intentional delays, and non-compliance with the legal notice. The cause of action is continuous and ongoing as the defect persists and no remedy has been provided till date.
Relief sought:
*. Direct the Opposite Party to replace the defective TV with a new and fully functional Kodak CA Pro *** cm TV OR, in the alternative, refund the full purchase amount of ₹**,***.
*. Award compensation of ₹**,*** for mental harassment, inconvenience, loss of use, and negligent conduct of the Opposite Party.
