Patel Packers And Movers - household material not delivered despite taking 80 of charges

The following is the notice I have sent to them that explains all:

"Sub: Shifting of household materials containing valuable items and documents. Illegal financial claims and malafide functioning thereto

Kind Attn : Ms Nisha,

*. This has reference to my telephonic call to you on **.**.**** in the afternoon wherein I solicited your services for shifting of my household materials to Mumbai and Midnapur West Bengal.
*. Based on my request, you had forwarded me by whatsapp the specific paraphernalia of your services with specifications of the packing materials to be used and also the commitment of proper experienced handling personnel and delivery schedule.
*. I had duly sent you the list of the major voluminous items in advance as also the approximated requirement of Card board boxes of the estimated size sent by you.
*. I had agreed for a consolidated payment of Rs*****/- for the full assignment of which I agreed to pay **% on proper pick up of the materials and balance **% on or before delivery at Midnapur West Bengal after receipt of your quote Ref: ******* dated **.**.**. This was confirmed by me by whatsapp on **th May ** itself.
*. Thereafter, on **th May **, your personnel reported to my place at Thane at *** am and started packing the materials. Surprisingly, I noted that the packing materials and Cardboard boxes as were informed to me on the previous day did not match the display. Infact, the Cardboard boxes were of inferior quality and also smaller in size. Over and above, excluding one, all other personnel sent by you were purely inexperienced. However, because of smaller sized boxes, the personnel packed the majority of the materials in plastic gunny type bags with no protection at all.
*. Late in the evening on **th May ** itself, when the scheduled materials for Mumbai got delivered, it was noted that because of inferior quality packing material, a lot of things got damaged and specifically, the foot studs of the washing machine gave away. I had immediately informed you about the same, and you promised me compensation towards the damages. Then, you instructed me to pay by cash Rs*****/- to the Packing incharge Mr Vikas, and I duly paid him cash and took a receipt. I was promised that the material for Midnapur would leave straight away.
*. On **th May **, I got ill and hospitalised. Surprisingly, I received a bill from your end with No ****** dated **.**.** for Rs *****/-. I immediately inquired with you that why is it **K instead of **K. You told me that the total no of packings have exceeded and hence the enhanced bill. Then I could understand the foulplay from your end, but was helpless because the materials by then were in your custody. I tried to explain to you that the scheduled sized boxes were not there and hence your personnel packed in smaller bags. This only resulted in the increase of no of packages. But you declined to accept the same. I had no way out but to agree and over and above, I was terribly sick.
*. On being released from hospital on **th May**, I had to rush to kolkata immediately because of the demise of one of my family members. On reaching kolkata and attending to the family grief, I got further sick and over and above, the Cyclone Yash hit west bengal for * full days. However, on **th, I got deposited Rs*****/- in your account by cash and solicited that you somehow deliver the materials by *th June** at the latest by which time the balance shall also be paid.
*. Surprisingly, you started black mailing me stating that warehousing charges etc shall be charged in addition etc etc.
**. You also informed me today that my costly household materials have not yet started from your Bhiwandi warehouse.

In the light of the above, the following may please be noted:
A. From the outset itself, you have breached all conditions of the services you had promised to me.
B. You failed to send the proper trained manpower for packing and loading.
C.You failed to send proper packing material for packing adequately resulting into improper packing and increase in number of packages.
D. There have been severe damages of the materials shifted to Mumbai.
E. After agreeing to a consolidated value of Rs*****/- as per your quote, you fraudulently sent me an invoice of Rs*****/- for the same.
F. Even after taking almost **% of the charges, you have not yet started despatch of the materials leave alone timely delivery.

Considering all the above, it is understood that you are continuously blackmailing me by keeping in your possession my valuable household materials worth almost *.*Lacs illegally.

You are therefore called upon to immediately deliver the materials in proper order latest by the **th of June **** wherein you shall be paid the balance on proper delivery. You are also called upon to respond to this mail in affirmative immediately or else consider this as a notice.

Incase, the delivery doesnot take place by the **th of June **, all statutory legal authorities shall be contacted to ensure that you refrain from all such illegal activities and be prosecuted as per the laws of this land including the damages and demurrages claimable by me."
