Paytm mall shopping - Fraud happen Duplicate Defected phone received

I purchased a phone and when I open it .
The charger is not working it's dead.
According to specifications it's mention you will receive user manual, warranty card, earphone and phone case. I didn't receive any of them. Plus when I open the phone it's start too much heating after * min.Sir I visited today near by gionee centre.
According to them the phone is malfunctioned, the IMEI No. is not showing on gionee portal and hence it's out of warranty, it's charger is duplicate, the charging jack of the phone is defected and also this phone is imported one because no phone of gionee in India has Chinese configuration and on the back of the phone IMEI sticker it's not there .
On back of the phone the Chinese print is also there. I contacted Paytm mall for return so many times they rejected again and again and Facinate by their in between commission. Please help me out of the same
