e bay - Delivered a defective and unresponsive item.

Both Ebay online shopping and seller concerned may provide detail in regard to their office address in India so that notice may be served to them under the appropriate law of the land.
Subject-If at the place of a genuine item a defective is being sold by Ebay online shopping through its seller which is unresponsive and not charging, whether Ebay can reject the refund claim by taking the recourse of fact that item comes under the category of manufacturer warranty not under the refund claim and they rejected my refund claim illegally and arbitrarily by overlooking own terms and conditions.
Highlights of the grievance are as follows.
*-I packed the item delivered by the Ebay online shopping as it is for further course of action.
*-If genuine item is substituted by a defective item, how the shopkeeper/seller and Ebay online shopping pursued the setup standard norms? Here this question arises that whether buyer/customer/purchaser had ordered for a defective item? That is why I have packed the delivered item as it is in order to prove that delivered item is defective one and Ebay online shopping by colluding with the seller deceived the applicant as well as infringed his consumer rights.
*- In general, the consumer rights in India are listed below:
The right to be fully informed about the performance and quality of all goods and services
The right to free choice of goods and services
The right to be heard in all decision-making processes related to consumer interests
The right to seek redressal, whenever consumer rights have been infringed
Whether it is justified to sell defective items without prechecking it before dispatch? Now when refund claim was made then staffs of Ebay online shopping rejected the claim in the name of manufacturer warranty. Everyone knows that manufacturer warranty and guarantee claims are enforced on those items which may be the underuse of customer/buyer but how the defective item may come under the category of manufacturer warranty.
*-Here ipso facto obvious from the attached documents to this representation, the seller is acting in caucus with the staffs of the Ebay online shopping and cheating innocent and gullible citizenry by sending the third-grade defective item at the place of the genuine item.

Ebay rejected the claim on Tue * Jun, at**:** (* days ago).
Ebay explicitly rejected the claim earlier than the response of seller which implies that both are colluding with each other in this unethical practice.
Here defective item is not tantamount to the old item but equivalent to the new genuine item as the old item can be refunded. At least old item might have operated so it may be better in comparison to defective item.
