MOST RESPECTFULLY SHOWETH:
*. That the complainants, including Brajdhar Kumar and others, are consumers of railway services provided by the opposite party, having purchased valid tickets for travel on the Humsafar Express from Darbhanga to Delhi and back.
*. That on January *, ****, and again on January **, ****, the complainants faced severe hardships during their journeys due to extensive and unjustified delays in the operation of the said train. The delays extended for several hours without any satisfactory explanation or assistance being provided by railway authorities.
*. That such delays have become a recurring issue, particularly at stations in Bihar, including Darbhanga, allegedly due to the collusion of railway officials with local agents and vendors engaging in corrupt practices to gain illegal commissions.
*. That the distress caused to passengers, including minor children, due to such delays and mismanagement is severe and unacceptable. One such incident involved a four-year-old child expressing extreme frustration and distress by repeatedly stating his intent to jump off the train due to prolonged delays.
*. That the complainants submit that the actions and inactions of the opposite party amount to deficiency in service and gross negligence, thereby causing physical discomfort, mental agony, and financial losses to passengers.
*. That the complainants seek the following reliefs from this Hon’ble Court:
a) An investigation into the reasons for the frequent delays and identification of responsible officials for appropriate action.
b) Compensation for the physical and mental agony suffered by the complainants and reimbursement of travel costs due to service deficiencies.
c) Directions to the opposite party to ensure punctuality, transparency, and the eradication of corrupt practices in railway operations.
d) Any other relief that this Hon’ble Court deems fit and proper in the interest of justice.
*. The complainants undertake to pay the requisite court fees and file supporting documents as per legal requirements.
PRAYER:
It is, therefore, most respectfully prayed that this Hon’ble Court may be pleased to:
