sameer wines Thane - wrongful debit

*. On July **, ****, I, Sukriti Sarwan and Sucheta Sarwan (jointly the “Complainants”), called for Smrinoff vodka (“Delivery”) from Sameer Wines, vide their home delivery service.
*. Sameer Wines, during the call requested from debit of Rs. **** for the Delivery. Sucheta Sarwan made the payment while having Sameer Wines on the call.
*. Sameer Wines called Complainants thereafter stating that to generate the invoice, the payment made by the Complainants needs to be registered. He requested the Complainants to make a payment to the credit account of Sameer Wines, consoling that the payment will not be made. The Complainants were unable to follow instructions after which Sameer Wines requested that the Net Banking confirmation of the Rs **** payment made by the Complainants be shared on whatsapp.
*. The Net banking confirmation was sent on *:**PM.
*. Complainants asked for a status updated at *:**PM, however no response was received.
*. The Complainants called Sameer Wines ** times after *:** PM for status update, however the call was not received. Finally Sameer Wines received call and stated that the status of whether ‘the Delivery will be sent or the payment will finally be refunded?’ will be provided to us later (‘baad mein batata hu’).
*. The payment has been received by Sameer Wines without the Delivery being provided to us.
Prayers
*. The refund of INR **** be provided to the Complainants
*. An amount of INR **** to be provided to the Complainants by Sameer Wines for mental agony caused, due to the curt behavior of Sameer Wines.
