Booked for New Maruti SWIFT ZXi AGS on **th Feb ** @ total price of Rs. ***,***/- & net price of Rs. ***, ***/- (after exchange of old car), through RNS Motors, Hosur Road Branch, Bangalore. Accordingly, Rs. **,***/- was paid as booking advance. Following is price breakup agreed during booking:
*. Applicable on road price as per catalogue on the date of booking was Rs. *,**,***/-..
*. For the bookings done in February **, there were discount offers from the Manufacturer , M/s Maruti Suzuki India Ltd.: such as Rs. **,***/- price discount + Rs. *,***/- Corporate discount on the market price. As these offers were from the manufacturer for the booking done in February **, same is to be applied for all the vehicles booked in February **, even though delivered after February **.
As per the booking confirmation, the vehicle should have been delivered within * to * weeks of booking. However, vehicle delivery was exorbitantly delayed by the manufacturer / dealer. It’s more than ** weeks of booking and the vehicle is yet to be delivered. Understand from M/s RNS Motors that the vehicle is just despatched from the manufacturer’s works and will take ** to ** days for delivery.
Since the booking advance is paid, the prices applicable during booking gets fixed. However, now the dealer M/s RNS Motors, Hosur Road Branch, Bangalore has disputed on all the above agreed rates during booking and refused to apply these offers. Informed that the offers as applicable during the time of delivery only will be applied. Presently (May **) the on-road price is increased by Rs. **,***/- (current on road price is Rs. ***,***/-) and the February ** announced price discounts and the corporate discounts are revised to Rs. *,***/- and Rs. *,***/- respectively.
Thus, there is over all extra price demand of Rs. **,***/- on the booking price by the dealer, for no fault of purchaser. In fact, the manufacturer / the dealer needs to compensate the purchaser for the delayed delivery of vehicle.
Claim lodged for compensation of Rs. **,***/- (Rs. **,***/- extra collected by the dealer from the agreed price + Rs. **,***/- penalty for delay, sufferings and other expenses.)
