Sub: Cheating, Misselling & Unethical practices by Club Mahindra and my painful experience with them.
Dear Team,
In the reference of the above subject, I would like to share my experience with you (which is not good at all in following aspects) and request you to resolve my problem at earliest. My Name is Sagar Goyal living Jaipur, Rajasthan. I want to share my experience with you in the following points.
*. One of the executives of Club Mahindra called me on **th January **** and told me that I was selected as * of the ** lucky winners for a * nights/* days fully free holidays + Rs. **,*** Kalyan Jewellers Voucher + couple movie ticket and asked me to come to Hotel, The Lalit, near the airport.
*. I went there and met Mr Ritesh, sales executive. He explained to me about the membership plan but didn’t tell that there are different season memberships like purple, blue etc. I was given blue season membership without explaining the difference among various membership plans.
*. I paid the down payment of Rs. **,*** and subscribed for it.
*. Next day, I went through the Club Mahindra website and got to know about different season memberships and got to know that my season membership (blue) doesn’t cover the summer school holidays and Christmas holidays. I was shocked because, in my interaction with Mr Ritesh, I told him that I am a teacher and plan my holidays in these vacations only. I also told him that I am getting married in the month of May **** and buying this membership as I want to go to my honeymoon in one of the locations Club Mahindra is having their properties. Despite knowing the fact that this membership plan doesn’t suit my requirement, he sold me the plan which I found cheating and misselling on his part.
*. I called Mr Ritesh immediately and asked about it. He accepted that my membership doesn’t include school holidays and Christmas holidays. I asked him why did he not tell me this earlier. He was not having the answer and accepted that he didn’t disclose all the facts.
*. I immediately told him that I want to cancel my membership. He promised me that he will take care of it. After calling him regularly for a few days, his superior Mr Sanjeev called me and asked why I want to cancel my plan. I explained to him everything. He also assured me that he will take care of my cancellation process and my money will be refunded in a few days.
*. After a few days, I called to customer care for knowing the status of my cancellation request. Customer care told me that there is no cancellation request and I have to send them a mail for the same.
*. On **th January ****, I marked them a mail for cancellation of my plan. I got a reply on **th January **** that my request has been sent to the concerned team.
*. After that mail, no communication happened from Club Mahindra. I called Mr Ritesh and Mr Sanjeev so many times but nobody replied to my calls. I checked the status with customer care and they repeatedly told me that my request is pending at Jaipur Branch’s end.
**. After no communication from Mr Sanjeev, I went to my twitter account and tweeted to Club Mahindra official twitter handle @clubmahindra on **st February **** and wrote everything happened to me. I received communication from their end but they also forwarded my grievance. Finally, my grievance was approved at the end of February ****. Customer care told me that my money will be refunded in ** working days as the procedure.
**. I called Mr Sanjeev and asked him why I should wait for ** days. He again assured me that this is standard time but I will get my money back within a few days as I didn’t activate my membership. I again took his words and waited for a few days.
**. When I didn’t get the refund, I called Mr Sanjeev, he said that I will be getting the refund at the end of May ****. I became so furious and tweeted to @anandmahindra and shared my problem. But nobody dealt with my problem. On the social media handle, they replied that request will be taken care of as the procedure. I sent emails too but every mail said the same thing.
**. After many tweets and mail, I got a call on **th April ****. I shared my complete grievance with Mr Manikandan K but he also didn’t comfort me. He also said the same thing that my money will be refunded at the end of May ****.
Few Questions I want to ask you about your unethical sales practices.
*. You called me on **th January **** and told that I had won a fully free *Nights/*days stay at Mahindra resort anywhere in India but voucher says that I have to pay Rs. **** at the time of check-in. Why this fact was not revealed in the call?
*. I was told that I won a Kalyan Jewellers voucher which can be redeemed on gold jewellery purchase but voucher says that it is redeemable on diamond jewellery and the making charges on gold jewellery. Why your executives are not telling the truth?
*. Why should I be suffered from getting my money refunded for the misspelling and cheating of your employee? Who will compensate me for the time I spent to communicate with you through all forms of media?
*. Why my money should be in your accounts for appx. * months without my mistake? Your employee lied but I am suffering for the last few months. I am losing daily interest on my money and nobody cares about it. Who will pay for that?
I want you to take the following actions immediately:
*. Refund my money within * days of receiving this letter with the interest rate of **% from **th January **** till the date of refund.
*. Terminate your employees, Mr Ritesh and Mr Sanjeev, immediately and take legal action for unethical practices.
*. I want the compensation of Rs. * crore for all the mental harassment, false commitments and suffering I am dealing with from January **, ****.
If you do not comply with all these actions within ** days of receiving this letter, legal actions will be taken against you. I am sending copies of this letter to the following offices.
