Rakesh Soni - Property dealer not refunding advance

Hi,
I paid advance of Rupees *****/- via phone pay (UPID) to a properly dealer Names Rakesh Soni, R/O FF-*** Harsha Mall Commercial Belt Sector Alpha -*, Greater Noida UP ******.
The dealer was supposed to find a plot for us and adjust the payment when deal is made. He found a plot but he asked me to pay **% amount in cash which i denied. i said i will pay ***% via DD or cheque the he refuse to find any such deal for me. later he refused to pay advance amount. can you help in this case to send a legal notice to him.
