J K Shah Classes - partial refund of fees not given for changing the coaching class mode from physical to online mode

Facts of the case:
*. I have paid fees for CA Final Classes of my son Ashutosh Gangan at J.K.Shah Classes Matunga Branch in February **** of Rs.*,**,*** + GST Totaling to Rs.*,**,*** for physical (offline) coaching. Copy of the receipt received from J.K.Shah Classes is attached herewith for your ready reference and record.
*. The fees for CA Final Coaching at Matunga Branch of J.K.Shah Classes is on a higher side as compared to other branches of J.K.Shah Classes because the student batch–size is considerably less as compared to other branches, since I wanted the admission at Matunga Branch only, I have accepted to pay these higher fees and took the admission in February ****.
*. After conducting approx *-* physical (offline) lectures, Covid-** Pandemic Struck our nation and the entire country was under lockdown. Hence, J.K.Shah Classes started conducting online lectures.
*. After starting online coaching classes, J.K.Shah Classes neither gave us any partial refund of fees paid nor did they gave us any exit option, as at the time of admission, fees were for offline physical mode of coaching. We know that the outbreak of Covid-** Pandemic was not in the hands of J.K.Shah classes but I believe that it was their moral duty to either refund partial fees or at least give exit opportunity to the students which they did not gave.
*. The coaching fees for online lectures at J.K.Shah classes itself is around Rs.______ and normally also, the fees for online coaching is considerably less as compared to physical (offline) coaching. Also, the benefit of small batch-size in Matunga Branch disappeared as in online mode many branches were taught simultaneously at the same time. Considering this, we requested J.K.Shah Classes to partially refund our fees paid to the tune of atleast */*rd of fees paid which comes around Rs.**,***/-
*. It is a fact that J.K.Shah Classes waived off the fee for * Elective Subject amounting to Rs.**,***/- for all the CA Final Students of J.K.Shah classes as a relief measure against Covid-**. But Rs.**,*** against a claim of Rs.**,*** is not a material sum.
I then wrote an email dt___to J.K.Shah Classes and requested for partial refund of fees, however, there was no response form them for some time. After waiting for about two weeks time , I ahd again reminded them for rsolution of the above mentioned issue, however, there was no positive response and they had refused to refund the partial amount of fees.

*. After frequent reminders and follow-ups, one Mr Patil has called up from J.K.Shah Classes and has informed that, they are ready to refund only Rs **,***/-, which was the amount extra charged by them for only Matunga branch, which initially they had denied to refund.

However, I could not accept this as, the refund they proposed is insignificant amount considering the total fees paid of Rs ******/-.

*. This is highly unfair, unjust and cheating of consumers on the part of J.K.Shah Classes.

*. All this process has caused a considerable wastage of my valuable time and has resulted in mental harassment to me.

**. I have given due personal notice to J.K.Shah Classes regarding my intention to file a complaint against them in the District Consumer Grievance Redressal Forum on failure of J.K.Shah Classes to refund the partial amount of fees of Rs **,***/-. This is evident in my email communications made to J K Shah Classes and and is enclosed herewith for your ready reference.

**. Since M/S J.K.Shah Classes have refused to entertain our due request to partially refund the fees paid , I now wish to file a complaint against M/S J.K.Shah Classes for charging unreasonably high fees after changing coaching mode from “offline physical” to “online” and for denying to refund partial amount of fees paid.

My Monetary Claim from J.K.Shah Classes:
I. Refund of Rs.**,***/- against fees paid by us for CA Final Offline physical coaching of Rs ******/-
II. Damages for causing mental harassment to me and wasting my valuable time used for going through all this process amounting to Rs.*****/-
III. Reimbursement of Expenses incurred in persuing the issue through Disctrict Consumer forum.
