Venkatesh Motors - Non refunding of advance amount

After locating the Hyundai Verna car through Cardekho website I approached the used car dealer M/s Venkatesh motors at Kolkata on **.**.****. I reached the dealer office in the evening after my office hours. Primarily the car seemed ok however as it was dark hours I told the dealer that after thorough checking the car in the day time I will decide for purchase. However, the dealer told that to hold the vehicle some token amount has to be deposited. So, going by his words I paid Rs ****/- through credit card. After making a payment instead of giving the receipt the dealer fraudulently got my sign on agreement paper (copy attached) wherein the condition of forfeiture of the advance amount was mentioned which I didn't notice on that day. Next day again it was evening after my office and I could not check the vehicle. On **.**.****, I reached the dealer in the afternoon and took a test drive of about ** km, for which the fueling charges were paid by me. As test drive seemed ok, I made up my mind to purchase the car and made payment through cheque but as per dealer the car to be delivered only on clearing the cheques. Lastly, it struck to me to check the engine in idle running condition. On checking, some ticking/ knocking sound was observed in the engine. Also, it was noticed that reverse parking sensors were not working. Moreover, the overall paint condition of the car was not appealing. The dealer was also not sure of how much time it will be taken to transfer RC. Considering all these facts I decided to drop the idea of purchase of that car and conveyed the dealer not to deposit the cheques. Now, I have requested to refund the advance amount. However, the dealer is denying to refund the same for no reason. Had it been known to me that advance amount will be forfeited. I would have never given advance without thorough checking. As it is my hard earned money, it is requested to arrange for a refund of the same.
