N D FURNITURE - item not delivered

In May ****, I was browsing through the internet to buy a set of wooden Swing in India I came across this company N&D Furniture located at No **/**, Arimuthu Maistry Street, Maistry Street Choolai Chennai ******.I called the contact mobile number +** ********** and spoke to the owner named Mr. Naresh Kumar. I arrange to meet him during my Divya Desam pilgrimage tour in June **** (**th June till **th July ****).
I arrived in India on **th June **** and **th June **** afternoon I went to his shop to view the sample items and place an order. The wooden plank sample was unfinish, and no chain sample was available. Mr. Naresh Kumar showed only photos to me. He promised to deliver the items at the same time my tour ends on **th July ****. Based on these promise words I confirmed my order at the price of INR**,***.** for the complete swing set.
On **th June **** I paid half of the amount INR**,***.** cash to Mr. Naresh Kumar at Residency Towers Chennai to start work on the swing. Again Mr. Naresh Kumar promised the items will be delivered few days after I return to Malaysia. After I return home on **th July ****, I didn’t hear from Mr. Naresh Kumar for about three weeks (**days) and I called Mr. Naresh Kumar.
Mr. Naresh Kumar mentions the items are not ready yet. Since then, I’ve been chasing
Mr. Naresh Kumar until the items are completed. On **th August **** Mr. Naresh Kumar shared pictures of the wooden plank that was completed and requested me to pay the balance and mention the items will be delivered after * weeks by sea freight. I paid the balance INR**,***.** to
Mr. Naresh Kumar on **th August **** via bank transfer. Mr. Naresh Kumar didn’t provide any shipping documents, only photos of the wooden plank and a box saying the chain and accessories were inside the box. In fact, I told Mr. Naresh Kumar to share pictures of items in the box before it was sealed. Mr. Naresh Kumar didn’t do as I requested.
After * weeks there is still no sign of my swing being delivered. I called Mr. Naresh Kumar so many times and given the run around. Many empty promises and refusing to answer my calls and ignoring my WhatsApp messages. Mr. Naresh Kumar didn’t bother to update me on the shipping progress. Finally, Mr Naresh Kumar provided the shipping agent Mr. C Murugan contact details from Chennai. I called Mr C Murugan and I made the arrangement for the item to be delivered.
Mr. Murugan gave me the contact details local agent in Malaysia for the delivery and I called the local agent in Malaysia Mr Prakash Marimuthu, Mr. Prakash Marimuthu mention nobody called from Chennai to deliver the items to me. In fact, Mr. Naresh Kumar was supposed to call
Mr. Prakash Marimuthu for delivery the items but Mr. Naresh Kumar didn’t follow up.
I made my own arrangements for the items to be delivered and the local agent charged me for the transport RM***.**. I was not told about these charges by Mr. Naresh Kumar. I paid INR**,***.** for the whole set and was told by Mr. Naresh Kumar that the price was included until door delivery. On **th October **** the delivery van came and to my shock only the wooden plank came, and no chain box as shown in the picture. When I called Mr. C Murugan in Chennai he mention Mr.Naresh Kumar gave him only the plank for shipment (one item only).
I immediately called Mr. Naresh Kumar, but he refused to answer. After many calls he answered and mentioned the chain box was being delivered by another shipping agent. I was not informed about these arrangements by Mr. Naresh Kumar from the beginning. Until towards the end when I received the plank Mr. Naresh Kumar didn’t bother to inform me that I would receive only the plank. When I started chasing Mr. Naresh for the Chain box, he asked me to deal with his staff named Mr. Anand. Mobile no: +** ********** I told Mr. Naresh Kumar that I will take legal action since I felt
that I’m cheated. Mr. Anand took over the arrangements for delivery of the chain box and since then the same empty promises and unbelievable stories to buy more time. I was assured by Mr. Anand that the box will finally be delivered on the *rd of November ****. On **th October **** when I called Mr. Anand, he mentions the chain box will be delivered on the *th of November **** before *pm.
On the *th of November **** I waited and waited but nobody called, and nothing came. I called many times to Mr. Naresh Kumar and Mr. Anand refused to answer the calls. I did mention in WhatsApp I need to take legal action against both of you for cheating a foreigner. In the evening
Mr. Anand called and said they had some issues with the shipping company and couldn’t deliver the item. Mr. Anand asked me for another day to finalize. On the evening of *th of November ****
Mr. Anand called and mentioned Mr. Naresh Kumar will courier another chain set. I refused and instead asked for a refund of INR**,***.** for the cost of chain and accessories. Mr. Anand mentioned he will inform Mr. Naresh Kumar and take full responsibility for the refund. I told Mr. Anand to make payment on *th November **** by noon India time. No confirmation was given to me for the full refund I requested from them both. When I called Mr. Anand, he was speaking very harshly to me and pushing his responsibility and asking me to deal with Mr. Naresh Kumar.
I contacted Mr. Naresh Kumar via WhatsApp, but he refuses to talk, he refuses to answer my messages and he only wants to refund what he feels is right. The price of the chain I requested for refund is a standard price quoted by all companies in Chennai based on the swing set.
Finally, I have no choice but to inform Mr. Naresh Kumar that I will be taking legal action to get my money back.
In fact, I’ve mentioned to Mr. Naresh Kumar and Mr. Anand you will in big trouble with local authority such as police and other related enforcement for cheating a foreigner. For these words I used, both of them want to impose defamation case against me for harassment for asking for the item I paid for or to refund my money.
I attached all documents and pictures shared by Mr. Naresh Kumar.
I humbly request you to investigate my predicament and hope action will be taken against this company for me to get my money back. This is the first time I’m dealing with a company in India and this experience will cast a black mark on the reputation of other India companies.
