Devyog Impex Pvt through Amazon Platform
- Impractical conditions imposed for Return of Defective item through Amazon Open
I had placed orders for two items in a single order to Amazon for * Function Fowler Hospital Bed for home and its fitting mattress on dated : **th March ****. These were supplied to me by M/s. Devyog Impex Pvt Ltd ***,Vishal Tower, District Centre, Janakpuri, New Delhi
Factory : E-***, MIA, Alwar on **th March, ****.
Since I placed the order to Amazon it should have been the responsibility of Amazon to arrange its return and refund me total amount paid as and when demanded within prescribed period.
On inspection of the bed I found it to be defective in many aspects mainly its one handle, which is ment for lifting front portion of the bed. In the picture sent to seller the ball- bearings and welding is visible clearly *making it a grossly defective item*. Since its mattress was ordered in a single order it was also to be returned.
Now Amazon has asked me to take-up the matter with supplier, who wilfully and deliberately supplied defective material asking me to pack this like original packing and transport it from Jaipur to Alwar at my own cost as a mandatory condition for return and after which they will inspect the items and decide for authorising Amazon to refund my money paid.
Obviously since they supplied defective item it cannot pass quality check /test. More over it is also obviously an impossible task for a home person like me not having facility for any kind of packaging & forwarding as not a factory person to pack this huge about *** kg weighing items which were ordered for home use only for my super old parents and I myself is also a senior- citizen (**+ years of age).
Apart from other things the supplier in his message through Amazon platform in its concluding last para dictated following one sided term to me (abstract of last para copy pasted from his message:-
"Therefore, to continue on your whims, we request once again that you get the bed packed properly and have it sent to our factory, and on complete quality inspection we shall refund the amount to you.
Justified deal is a two way street."
To this I sent following message to the supplier :-
The same as per "Principle of Natural justice" ( nemo judex in causa sua) applies to me as an Amazon buyer. As after receiving the order under question - on inspection I found product defective. Hence you as an Amazon Supplier must collect them at your own expenses & refund.

*No reply to this is given by supplier till this time.*
The salient points of reasons mentioned to supplier by me supported with pictures through email are as under:-
*. Packaging was bad, no Amazon packaging used. No box packaging was used by supplier.
*. Fixing side rest slot damaged.
*. *One handle defective (ball -bearings and welding can be seen in picture sent to the seller using Amazon system in reply to sellers message)- This is major unacceptable defect.*
The behaviour of Supplier and dealing with Amazon who instead of taking up the matter of return with the supplier in question forced upon me to deal with supplier, has caused great mental agony to me and my ailing super old parents (father ** years and mother about ** years), we all are suffering very much due to the act of Amazon and the supplier who both are shirking from their responsibilities.
I demand due compensation with all consequential benefits for mental agony, trauma and direct loss caused to me due to impractical conditions imposed on me as I placed order under question to "Amazon" and not to seller directly. No shipping charges were there and was paid for supply of this particular twin order, so for returning defective product asking me (the Amazon buyer) to pack this huge about weighing *** Kg items and sending it to Alwar ( I was not knowing that this particular supplier is from Alwar, at the time of placing order to Amazon) is bad in law.
Hence on account of trauma, mental agony and cost paid to Amazon, due compensation with all consequential benefits may be provided to me in the interest of justice.
