*. That I, Anita Srivastva and Santosh Kumar Srivastava, the complainant. I had availed a holiday package from the Luxury Country Royal Holidays INN & Suits Pvt Ltd (LCH), First Floor, Block-A, A-*, Sector-**, Noida, Uttar Pradesh ******, on the **th of April ****, vide invoice/membership number [LCHXXXXX], with an entitlement of * nights per year at any destination provided by the company. The day I regret of falling under trap of Ashu Kohli, salesman of LCH. This Punjabi guy was well trained in sales and presented a whole rosy picture of my family vacation for next ** years.
*. I fall in their trap and swipe my card for Rs *,**,***. They asked me to convert this transaction in No-Cost EMI, but when bill comes, it came with interest of total Rs *****
*. That, in accordance with the terms of the holiday package, I requested a booking for my holiday in Gangtok for the month of October ****. However, to my surprise, the LCH denied my request and asked me that Gangtok location is not active for them now and I need to change the location.
*. Thereafter, upon the insistence of the LCH, I requested for a holiday booking in Goa as an alternative destination. However, they further arbitrarily limited the booking to only * nights, despite my entitlement being for * nights under the package agreement. This is a clear breach of contract and deficiency of service.
*. That I have contacted the LCH several times, and despite my repeated requests to rectify the issue and fulfill their obligations under the contract, they have refused to do so, causing me undue harassment, mental agony, and financial loss.
*. That the Opposite Party’s refusal to honor the terms of the package, coupled with their arbitrary reduction of the booking to * nights, amounts to an unfair trade practice, and is in clear violation of my consumer rights.
*. I requested LCH customer care to cancel the membership and return my money, which they denied by saying that its non-refundable contract and they will not return any money.
