I, the above deponent do hereby solemnly affirm and declare as under:-
*. That I am the Petitioner in the above case, thoroughly conversant with the facts and circumstances of the present case and am competent to swear this affidavit.
*. That in **-**-**, I bought a Panasonic TV from an authorised dealer Vijay Sales (India) Pvt. Ltd. located at K-* TO K-*, SECTOR ** GAUTAM BUDH NAGAR, NOIDA, UTTAR PRADESH- ******.
*. That the invoice no is: UND-C-*******
*. That on October *, ****, I registered a complaint with Panasonic Customer Care regarding her Panasonic TV which is under warranty.
*. That I was informed that a technician would visit my location on October *, ****, to provide service.
*. That I took leave from work on October *, ****, in anticipation of the technician's visit. However, the technician never arrived.
*. That I contacted Panasonic Customer Care on October *, ****, and was informed that the technician had a medical emergency and that the service date would be rescheduled to October **, ****.
*. That I took another leave from work on October **, ****, in anticipation of the technician's visit. However, the technician never arrived again.
*. That I again contacted Panasonic Customer Care on October **, ****
**. That on October **, ****, two technicians arrived at my location to provide service. They diagnosed the problem with the TV and informed me that the necessary parts would be replaced within five working days.
**. That, the technicians only visited my premises after continuous intimations from the morning to evening through calls and emails from **th of October and at approximately *:**p.m, I received a call from the technician for the service on the aforesaid day before declaring that the parts will be changed within five working days like previously stated.
**. That after the aforementioned date, I didn’t receive any update till the **th of October.
**. That on **th October, **** I called, emailed and twitted for the support and then I received an email mentioning that the service will be provided on **st of October but nobody arrived to provide service at my location.
**. That on October **, ****, I contacted Panasonic Customer Care to inquire about the status of the replacement parts. However, the number was given to me of Area Manager to talk with him and get the update related my enquiry, I called multiples of time on his number but he didn’t responded to my any single call.
**. That then, I again posted to X (formerly known as Twitter) @Panasonicindia regarding my issue. I received a response from Panasonic, assuring me that the issue would be resolved soon.
**. That then, I received an email from Panasonic Team informing me that the service date had been rescheduled to October **, ****.
**. That it was on October **, ****, I contacted the Area Manager at Panasonic to confirm the service appointment after I received communication from your concern via email on that very day only. I was assured that a technician would visit my location on October **, ****.
**. That on October **, ****, no technician arrived at my client's location. I contacted the Area Manager multiple times, but he did not respond to any of my calls.
**. That, I am very much depressed with this situation.
**. That, despite of numerous intimations and requests there was no resolution provided to me from their end.
**. That I would like to add that while buying the Panasonic TV we are assured that we will pay for three years warranty period as suggested by the sales boy but only * years mentioned in the invoice.
**. That because of my mother in law serious condition of cancer we forgot to check the invoice thoroughly and kept in our self but as the problem started in the TV we noticed in Invoice only two years warranty has been mentioned.
**. That I want the dealer to give the correct invoice to me.
**. That, being deprived of the facilitated service I intimated their concern on several occasions by way of telephonic conversations and emails in respect of the above mentioned issue. However, they have acted like flogging of a dead horse in order to provide resolution which is extremely unprofessional in nature.
**. That, I kindly requests that you investigate this matter thoroughly and take the necessary steps to ensure that their concern addresses this issue promptly. Furthermore, I urge you to implement any appropriate actions to prevent such incidents from occurring in the future, as it affects not only my but also other consumers who may face similar problems.
**. That Panasonic is liable because I have suffered significant inconvenience, mental harassment, and financial loss due to:
• Breach of Contract
• Negligence
• Unfair Trade Practice
• Misbehave
• Arrogant Reply
**. That, I demands the following relief:
• That you initiate an entire refund of ₹**,*** (Rupees Thirty One Thousand Three Thirteen Only) which I paid for the product.
• That they provide a compensation of ₹**,*** (Fifty Eight Thousand Only) for the mental harassment and loss of time that I had to suffered taking lots of leaves and filing a case cost.
• That I spent Rs.**** on Online Legal India for legal Justice, they had sent the notice to them but they didn’t respond and the Online Legal India is charging me more **,*** to file the case in the court. I am helpless now and cannot afford to pay anymore.
• That Panasonic accept liability for its breach of contract and compensate me for the mental distress and loss of time that I have suffered.
I look forward to your reply and a resolution to my problem which I shall be constrained to initiate
against them for redressed of the aforesaid grievances and recovery of the aforesaid amount such
proceedings, both civil and Criminal as are warranted by Law, besides filing a complaint under the
statutory Provisions of The Consumer Protection Act, **** exclusively at your own risk, cost,
responsibility, and consequences.
