- Breach of Agreement by Hotel Open

This is in regards to the conduct of my "Sangeet Ceremony" function that was conducted at the Venue: Crystal Ball Room at The Lalit Chandigarh on ** Nov **. My father had arranged for the booking of the venue and was dealing with Ms. Priya Sharma, Manager Sales during negotiations and finalised the venue. During the course of the booking, an agreement was brought in place between the Hotel and my father, Mr. Pawan Sharma who was getting the arrangements done for my wedding. The facts of the matter are as follows:-
- Throughout the course of discussion and on various other occasions during negotiations, it was reassured to us that in case Total No. of Guests showing up for the event doesn't complete the Minimum Guaranteed Billing Amount, the residual amount that is otherwise shown as Hall Rental in the Agreement can be utilised against availing Liquor. (As per Schedule - I, Para - * (f)(g) of the Agreement).
- With this understanding and agreement of requirement as projected by my father and agreed upon by Ms. Priya Sharma on behalf of the hotel, we went ahead and confirmed the booking.
- One day prior to the event also, a meeting was held between Ms. Priya, self (Mr. Siddharth), Mr. Anurag and my sister (Ms. Salony Bhardwaj) for Tasting of Food wherein it was clearly reiterated that in case of non utilization of the Min Guaranteed Billed Amount, we would like to avail the balance amount in the form of Sealed Liquor Bottles from the Hotel at the Hotel Prices itself and as always we were reassured that the same would be facilitated.
- On the night of the event, after culmination of the event, the Banquet Manager Mr. Anurag without any clarification or confirmation sought from my father, prepared the invoices and sheepishly charged the leftover balance amount towards Hall Rental.
- My father was neither informed nor was the clarification sought from him if he wanted to avail the leftover amount's liquor or not, and the amount in the bill was reflected against Hall Rental. In his understanding, the Hotel was going to provide the Bottles as mentioned in Schedule - I Para * (f)(g) of the Agreement. As it was well past midnight while we vacated the premises, we went home under the impression that the same account of availing Liquor Bottles can be done on the next day.
- It is worthwhile to mention here that Mr. Anurag or Ms. Priya Sharma DID NOT provide any clarification on the matter on any occasion, that the Liquor Bottles had to be taken on the same date as the event and when contacted on the next day, simply did not respond in regards to providing liquor.
- It was only on the second day after the event that Ms. Priya responded and cited her inability to meet her part of the agreement because the invoice had already been generated (on the end of the event) and now Liquor cannot be provided. Nowhere in the Agreement is it mentioned that the same had to be availed on the day of the event and the same was also never clarified whenever it was promised and reassured by Ms. Priya that we can avail Liquor from the Hotel.
- In any case, the Hotel itself has closed the invoices on ** Nov @ **:** AM which just shows how the Hotel is Breaching it's customers trust in them. Bottles of Liquor could have very well been provided on the next day also. The Hotel had sufficient time on the next day also to settle the account and all efforts were made to reach out to our Point of Contact Ms. Priya but she didn't provide any useful update on the matter and took her own time to finally respond on the issue on ** Nov **.
- If there was an option to charge the balance amount towards Hall Rental or Utilisation in the form of Liquor (as mentioned in the Agreement) why wasn't clarification of consent taken from my father while settling the Invoice and instead sheepishly charging it only to refuse to give the liquor on the following day.
- Sufficient efforts have been made to resolve the issue and the Sales Head Ms. Parul Dewan was also contacted over the phone as well as over email in regards to this issue but to no avail.
