Ozaz Cabs Pvt Ltd - After deposit Money did not execute agreement made court paper

That the Complainant is a law abiding citizen of India residing at the address mentioned in the cause title of the complaint petition.
*. Complaint against Ozaz Cabs Pvt. Ltd. a Private Limited Concern having CIN no.U*****WB****PTC******, Pan no. AACC*****F, TAN NO. CALO*****A, GST no. **AACC*****F*Z*, TL NO.- **************** having its registered office at ***, *th Floor, AMP Vaisakhi Mall, AG-***, AG Block, Salt Lake Sector-*, Bidhannagar, Kolkata-****** for cheating, fraud, criminal intimidation, wrongful loss and fraudulent activities and duping me an amount of Rs. *,**,***/- ( Rupees One lakh)
*. `I, the undersigned would like to inform you that while going through Anandabazaar newspaper ad, I came to know about the above named car cab company being Ozaz Cabs Pvt. Ltd.
*. That I subsequently contacted their office no. at ********** and started conversing regarding their nature of business. That a woman namely Sunita Roy, claiming herself to be the Director of the company even visited my house at Netaji Nagar, Kolkata-****** and demonstrated me about the company and their business and told me that if I give them Rs.*,**,***/- then they will buy a car in my name and the rest amount will be paid by the company regarding the purchase in installments and they will be pay me Rs. *,***/- every month as rent for the car. They even said that they will be provide me the said car to use it for personal use for ** days every year and after * years they will return back the said car to me.
*. Then I being convinced by their conversation and demonstrations I made a payment of around Rs. *,**,***/- ( Rupees One Lakh) only by the dint of a cheque issued in favour of Ozaz Cabs Pvt. Ltd. vide Punjab National Bank, Bijoygarh Branch and the same was issued by me, Indrani Roy Chouwdhury and they duly collected the said cheque from my house at Netaji Nagar, Kolkata-****** and the same was duly encashed by Ozaz Cabs Pvt. Ltd. in their Bank Account on **.**.****.
*. We even executed a Car Lease Agreement dated **.**.**** where the terms and conditions have been laid down between us. That as per our verbal Agreement it was decided that within ** days they will buy the car and start renting it and I will start getting the Rs. *,***/- per month from January, ****.
*. But to my utter astonishment even after one month, the above company neither paid me Rs. *,***/- nor gave us the paper of the car that they are supposed to buy for us. That I have even sent those several reminders and at the same time even visited their office but every time they came up with an excuse and told us wait for few more days.
*. That a person who introduced himself to be S Chatterjee and an employee of Ozaz Cabs Pvt. Ltd. called me up from a phone no. ********** and assured me that I will start getting the money from March, **** and the delay is due to corona and the company staffs being affected by corona. That I again called them in the month of March, **** and the same person namely S Chatterjee came up with another excuse and told us to wait for few more days.
*. That I made several phone calls to S Chatterjee at ********** and the said Sunita Roy in her phone no. ********** personally and requested them to either pay the Rs. *,***/- or refund the payment of Rs. *,**,***/- which I have made to them.
**. But they kept giving lame excuses whenever I called them and complained for not refunding my payment and they would seek more time and gave a date which they were unable to comply and this continued on day after day.
**. That for the last few days whenever I am calling them, they are avoiding my calls and sometimes it is coming switched off. That few days back when I again called them and told them to return my money, Sunita Roy and S Chatterjee abused me in the filthiest of languages, gave death threats and said that they will not return me the money anymore and if I try to complain before the police or any authority then I will face dire consequences.
**. That I am living in great fear and moreover fear that I will lose my hard earned money of Rs. *,**,***/- (Rupees One Lakh) only. After this huge financial loss, I am facing a lot of difficulty in my day to day life and facing huge economic constraint.

I have already a lodged a complaint with the concerned P.S. on **.**.**** however even after passing of so many days no F.I.R. has been drawn up yet and no investigation done although the above accused persons are still advertising in leading newspaper and are duping customers like us. (Copy Attached as Annexure D)
**. So, it’s my humble request to you to take necessary steps and actions through which I can get back my money and take strong legal action against the fraudster company Ozaz Cabs Pvt. Ltd., their Director Sunita Roy, their employee S Chaterjee and other officials of the company who have collectively defrauded and cheated me.

That the Complainant states that the above mentioned dispute clearly states that there was negligence on the respondent and the said respondent company is running an Unfair Trade Practice in order to dupe the hard earned money of the complainant wherein respondents have intentionally provided the de novo dreadful and deceitful service to the complainant and has not provided the proper and facilitated services towards him which has caused his unnecessary notice agony and stress.
**. That the Respondents have miserably failed in providing right and proper service despite the Complainant has paid the full amount to the respondent authority and thereby causing deficiency in service.
**. That the instant Complaint is filed within the prescribed time period in terms of the provisions of the Consumer Protection Act, ****.
**. That the Complainant makes payment of the requisite Court Fees.
**. That the Complaint is made bona fide and for ends of justice.
**. That there is no suit pending nor has been decided on the same subject matter between the parties by ant competent court of law other than the described one.
**. That the instant Complaint is within the jurisdiction of this Learned Forum
